0 <br />THE CHAIRMAN CALLED FOR THE (QUESTION. COMMISSIONERS DEESON, <br />SCHMUCKER AND CHAIRMAN WODTKE VOTED IN FAVOR OF DENIAL. COMMISSIONER <br />Loy VOTED IN OPPOSITION. THE MOTION CARRIED. <br />ATTORNEY STEWART STATED THAT HE WISHED TO ENTER AN OBJECTION TO <br />COMMISSIONER SIEBERT'S PARTICIPATION IN THE DISCUSSION OF THIS MATTER AND <br />HAVE IT ENTERED IN THE RECORD. <br />COMMISSIONER SIEBERT RETURNED TO THE MEETING. <br />CHAIRMAN VIODTKE ANNOUNCED THAT THE PUBLIC HEARING IN REGARD TO <br />THE TROPIC GROVE DEVELOPMENT C"?RPORATION SEWER FRANCHISE WOULD BE <br />CONTINUED AS SCHEDULED, <br />DEAN LUETHJE APPEARED REPRESENTING TROPIC GROVE DEVELOPMENT <br />CORP. AND INFORMED THE BOARD THAT THEY HAVE NOT YET BEEN ABLE TO COME TO <br />ANY FINAL AGREEMENT WITH MR. BOGOSIAN AND THE 32 EXISTING CONDOMINIUM <br />OWNERS AND WOULD REQUEST A CONTINUATION OF THE PUBLIC HEARING FOR AT <br />LEAST 3O DAYS. <br />COMMISSIONER LOY ASKED WHEN THEY ARE FINALLY READY WITH THEIR <br />PROPOSAL, WILL IT BE SUBSTANTIALLY DIFFERENT FROM THE ONE ORIGINALLY <br />PRESENTED? <br />MR, LUETHJE STATED THAT HIS CLIENT WANTED HIM TO EMPHASIZE THAT <br />THEY DEFINITELY DO WANT TO COME TO SOME FINAL CONCLUSION AND IT IS <br />POSSIBLE THAT IT MIGHT BE SUBSTANTIALLY DIFFERENT FROM THE ORIGINAL <br />PRESENTATION. <br />CHAIRMAN WODTKE NOTED THAT IN THIS CASE, HE WOULD SUGGEST THIS <br />PUBLIC HEARING BE CONCLUDED AND A NEW ONE ADVERTISED AS T14E BOARD IS LIM- <br />ITED TO DECIDING ON THE REQUEST AS ADVERTISED. <br />MR, LEUTHJE AGREED THAT THEY WOULD READVERTISE AND SET UP A <br />NEW PUBLIC HEARING AND REPUESTED THAT THIS MATTER NOW BE WITHDRAWN FROM <br />THE AGENDA WITHOUT PREJUDICE. <br />ON MOTION BY COMMISSIONER Loy, SECONDED BY COMMISSIONER SIEBERT, <br />THE BOARD UNANIMOUSLY GRANTED MR. LEUTHJE'S REQUEST FOR WITHDRAWAL WITHOUT <br />PREJUDICE. <br />ATTORNEY COLLINS GAVE THE BOARD A BRIEF HISTORY OF TREASURE <br />COAST UTILITIES APPLICATION FOR A REVISION OF RATES, STATING THAT ON MAY <br />5, 1976, THE BOARD APPROVED AN ASSIGNMENT OF THE SOUTHERN GULF UTILITIES <br />WATER & SEWER FRANCHISE TO TREASURE COAST UTILITIES, INC.
