RESOLUTION NO. 2008- 172 <br />A RESOLUTION BY THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, APPROVING THE PREFERRED <br />ALIGNMENT FOR IMPROVEMENTS TO 27TH AVENUE (C.R. 607) <br />BETWEEN 17TH STREET SW AND 5TH STREET SW; APPROVING THE <br />PREFERRED POND SITE FOR THE FUTURE IMPROVEMENTS TO 27TH <br />AVENUE (C.R. 607) IN THE AREA OF THE INTERSECTION WITH OSLO <br />ROAD (C.R. 606); DETERMINING THE NECESSITY OF ACQUIRING <br />CERTAIN REAL PROPERTY FOR IMPROVEMENTS TO OSLO ROAD <br />(C.R. 606), AND FOR IMPROVEMENTS TO 27TH AVENUE (C.R. 607); AND <br />AUTHORIZING THE COUNTY ATTORNEY TO ACQUIRE PROPERTY BY <br />PURCHASE OR EMINENT DOMAIN <br />WHEREAS, Indian River County (the "County") is a political subdivision of the State <br />of Florida; and <br />WHEREAS, Indian River County is one of the fastest growing counties within the <br />State of Florida; and <br />WHEREAS, the continued growth in Indian River County has greatly increased the <br />vehicular traffic within the County roadway network; and <br />WHEREAS, portions of Oslo Road (C.R. 606) and portions of 27" Avenue (C.R. <br />607) are unable to adequately accommodate expected future vehicular traffic, <br />management of access, drainage, water retention, and are in need of improvement; and <br />WHEREAS, improvementsto Oslo Road (C.R. 606) between Old Dixie Highway and <br />43rd Avenue, and 27`" Avenue (C.R. 607) between 17'" Street SW and 5`" Street SW are <br />included in the County's 2020 Comprehensive Plan Capital Improvements Element, as <br />adopted by Ordinance 2007-034 and in the County's County's 2020 Comprehensive Plan <br />Transportation Element, as adopted by Ordinance 2006-030; and <br />WHEREAS, County staff and its consultants have presented a preferred alignment <br />for the 27`" Avenue (C.R. 607) roadway improvement project; and <br />WHEREAS, County staff and its consultants have presented the preferred pond <br />siting for the 27" Avenue (C.R. 607) roadway improvement project in the area of the <br />intersection with Oslo Road (C.R. 606); and <br />WHEREAS, the County does not have the interests in real property necessary to <br />provide for such improvements; and <br />WHEREAS, it is in the public interest and for the benefit of the public to improve <br />Oslo Road (C.R. 606) and 27'" Avenue (C.R. 607); and <br />
