RESOLUTION NO. 2008-172 <br />WHEREAS, the acquisition of the real property described herein is necessary to <br />construct and maintain improvements to Oslo Road (C.R. 606), and to construct and <br />maintain improvements to 27'h Avenue (C.R. 607); and <br />WHEREAS, the estate and interest in the real property described herein is <br />necessary to adequately accommodate the planned improvements, expansions, and/or <br />alterations to Oslo Road (C.R. 606) and 27th Avenue(C.R. 607); and <br />WHEREAS, pursuant to Chapters 127, 73 and 74, Florida Statutes, the County is <br />authorized to exercise the power of eminent domain: <br />NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners <br />of Indian River County, Florida, as follows: <br />1. After due consideration of many factors, including but not limited to the <br />availability of alternate routes, costs, environmental factors, long-range area planning, and <br />safety considerations, the preferred alignment for 27" Avenue (C.R. 607) as described in <br />the 27" Avenue Route Study Between 17th Street SW and 5th Street SW prepared by <br />Kimley-Horn and Associates, Inc. and dated August 2008, which is hereby incorporated <br />by reference into this Resolution, is hereby ratified and approved. <br />2. After due consideration of many factors, including but not limited to the <br />availability of alternate routes, costs, environmental factors, long-range area planning, and <br />safety considerations, the preferred pond site for the 27th Avenue (C.R. 607) roadway <br />improvement project in the area of the intersection with Oslo Road (C.R. 606) as described <br />in the Pond Siting Report prepared by Kimley-Horn and Associates, Inc. and dated June <br />2007, which is hereby incorporated by reference into this Resolution, is hereby ratified and <br />approved. <br />3. The Board of County Commissioners hereby finds that the recitals above are true <br />and correct, and that acquiring fee simple title to the real property described in Composite <br />Exhibit "A" as Parcel Nos. 45A, 45B and 60 is necessary for the public purpose of <br />improving Oslo Road (C.R. 606) and 27th Avenue. <br />4. The County's attorneys are authorized and directed to institute such negotiations, <br />eminent domain proceedings pursuant to Chapters 73 and 74, Florida Statutes, and other <br />collateral proceedings, so as to allow the County to take title and possession in fee simple <br />of Parcel Nos. 45A, 45B and 60. <br />
