RESOLUTION 2006- 165 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN <br />RIVER COUNTY, FLORIDA, PROVIDING FOR THE CLOSING, <br />ABANDONMENT, VACATION AND DISCONTINUANCE OF A PORTION OF 46th <br />AVENUE (SUNRISE STREET) BETWEEN ORANGE STREET AND CR510 AND <br />A PORTION OF 46TH AVENUE (SUNRISE STREET) BETWEEN US HIGHWAY 1 <br />AND 84TH STREET AS SHOWN ON PLATS OF WEONA PARK, GRAVES <br />ADDITION TO WABASSO, AND MAINTENANCE MAP OF 46TH AVENUE, <br />RESERVING A DRAINAGE AND UTILITY EASEMENT OVER THE ENTIRE <br />RIGHT-OF-WAY, SAID LAND LYING IN INDIAN RIVER COUNTY, FLORIDA <br />WHEREAS, on August 5, 2005, Indian River County received a duly executed and documented <br />petition from Indian River County Capital Projects, requesting that the County close, vacate, abandon, <br />discontinue, renounce and disclaim any right, title and interest of the County and the public in and to a <br />portion of 46th Avenue (Sunrise Street) between Orange Street and CR510 and a portion of 46th Avenue <br />(Sunrise Street) between US Highway 1 and 84th Street as shown on plat of Weona Park and <br />Maintenance Map of 46th Avenue of Weona Park, Plat Book 2, Page 17, Graves addition to to Wabasso, <br />Plat Book 2, Page 41 and Maintenance Map of Sunrise Street (46th Avenue), Plat Book 14, Page 46 of <br />Indian River County, Florida, said lands now lying and being in Indian River County, Florida; and <br />WHEREAS, in accordance with Florida Statutes 336.10, notice of a public hearing to consider <br />said petition was duly published; and <br />WHEREAS, after consideration of the petition, supporting documents, staff investigation and <br />report, and testimony of all those interested and present, the board finds that the subject right-of-way is <br />not a state or federal highway, nor located within any municipality, nor is said right-of-way necessary <br />for continuity of the County's street and thoroughfare network, nor access to any given private property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. All right, title and interest of the County and the public in and to those certain rights-of-way <br />more particularly described as follows: <br />A) <br />THAT PORTION OF 46TH AVENUE F/K/A SUNRISE STREET (PLATTED 25' <br />RIGHT-OF-WAY) LYING NORTH OF THE NORTH RIGHT-OF-WAY LINE OF <br />ORANGE STREET AND SOUTH OF THE PROPOSED SOUTH RIGHT-OF-WAY <br />LINE OF COUNTY ROAD 510. ALSO INCLUDING THE EAST 30 FEET OF <br />ORANGE STREET (25' RIGHT-OF-WAY). SAID SUNRISE STREET AND <br />ORANGE STREET AS SHOWN ON THE PLAT OF WEONA PARK AS <br />RECORDED IN PLAT BOOK 2, PAGE 17 OF THE PUBLIC RECORDS OF <br />INDIAN RIVER COUNTY, FLORIDA. NOW LYING IN INDIAN RIVER <br />COUNTY, FLORIDA.
