RESOLUTION 2006- 165 <br />THE ENTIRE MAINTENANCE RIGHT-OF-WAY AS RECORDED IN THE <br />PLAT "MAINTENANCE MAP OF SUNRISE STREET (46TH AVENUE) FROM <br />85TH STREET TO COUNTY ROAD 510" RECORDED IN PLAT BOOK 14, <br />PAGE 46 OF THE PUBLIC RECORDS OF INDIAN RIVER COUNTY, <br />FLORIDA, BOUNDED ON THE NORTH BY THE PROPOSED SOUTHERLY <br />RIGHT-OF-WAY LINE OF COUNTY ROAD 510, AND BOUNDED ON THE <br />SOUTH BY THE EASTERLY PROJECTION OF THE SOUTH RIGHT-OF-WAY <br />LINE OF 85TH STREET F/K/A 4TH STREET S., ACCORDING TO THE PLAT <br />OF GRAVES ADDITION TO WABASSO RECORDED IN PLAT BOOK 2, PAGE <br />41 OF THE PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA. <br />NOW LYING IN INDIAN RIVER COUNTY, FLORIDA. CONTAINING <br />14,385.09 SQUARE FEET, MORE OR LESS, OR 0.33 ACRES. <br />THAT PORTION OF SUNRISE STREET (35' RIGHT-OF-WAY) LYING SOUTH <br />OF THE SOUTH RIGHT-OF-WAY LINE OF 84TH STREET F/K/A 6TH STREET <br />S. AND NORTH OF THE PROPOSED EASTERLY RIGHT-OF-WAY LINE OF <br />US HIGHWAY 1. SAW SUNRISE STREET AS SHOWN ON THE PLAT OF <br />GRAVES ADDITION TO WABASSO AS RECORDED IN PLAT BOOK 2, PAGE <br />41 OF THE PUBLIC RECORDS OF INDIAN RIVER COUNTY, FLORIDA. <br />NOW LYING IN INDIAN RIVER COUNTY, FLORIDA. CONTAINING 9,999.33 <br />SQUARE FEET, MORE OR LESS, OR 0.23 ACRES. <br />Lying in Indian River County, Florida. <br />is hereby forever closed, abandoned, and vacated, except that a drainage and utility easement is <br />expressly reserved for drainage and utility purposes, over the entire right-of-way. (see Exhibits <br />"A" and "B" attached) <br />2. The closing, vacation, abandonment, of this public right-of-way is in the best interests of the <br />public. <br />3. Notice of the adopting of this resolution shall be forthwith published once within thirty (30) <br />days from the date of adoption hereof; and <br />4. The Clerk is hereby directed to record this resolution together with the proofs of publication <br />required by Florida Statutes 336.10 in the Official Record Books of Indian River County <br />without undue delay. <br />5. The rights-of-way A shall revert evenly to the adjacent property on either side of the right-of- <br />way. Right-of-way B shall revert to the platted property to the west. <br />The foregoing resolution was offered by Commissioner Lowther who moved its <br />adoption.
