RESOLUTION 2005 - 177 <br /> INDIAN RIVER COUNTY RESOLUTION DECLARING <br /> STATE OF LOCAL EMERGENCY <br /> WHEREAS, the National Hurricane Center recognizes the danger to coastal <br /> residents of Florida from Hurricane Wilma, by posting a Hurricane Warning from <br /> 1r--hLLae*dyj qP to;. # W. and <br /> WHEREAS, Indian River County has residents and businesses still recovering from <br /> the cumulative impact of Hurricane Frances and Hurricane Jeanne, which made <br /> landfall in our county in 2004; and <br /> WHEREAS, Hurricane Wilma could produce in excess of 6 inches of rainfall in <br /> Indian River County; and <br /> WHEREAS, Hurricane Wilma's extreme weather conditions pose an immediate <br /> danger to the lives and property of the vulnerable residents of Indian River County; <br /> and <br /> WHEREAS, Chapter 252.38, Florida Statutes, provides authority for a political <br /> subdivision such as Indian River County to declare a State of Local Emergency and <br /> to waive the procedures and formalities otherwise required of political subdivisions <br /> by law pertaining to: <br /> 1. Performance of public work and taking whatever action is necessary <br /> to ensure the health, safety, and welfare of the community. <br /> 2. Entering into contracts. <br /> 3. Incurring obligations. <br /> 4. Employment of permanent and temporary workers. <br /> 5. Utilization of volunteer workers. <br /> 6. Rental of equipment. <br /> 7. Acquisition and distribution,with orwithout compensation of supplies, <br /> materials and facilities. <br /> 8. Appropriation and expenditure of public funds. <br /> WHEREAS, the Board of County Commissioners of Indian River County on October <br /> 20, 2005 by Resolution 2005- %' ' , delegated to County Administrator Joseph A. Baird <br /> the authority to proclaim and declare a State of Local Emergency in Indian River County. <br />
