�SSISTANT PLANNER PERG STATED THAT THE ORDINANCE PROVIDES THAT <br />NO EASEMENT SHALL BE ENCROACHED UPON, BUT NOTED THAT IF HEAVY EO.UIPMENT <br />HAD TO BE BROUGHT IN ON AN EASEMENT AND WAS TOO CLOSE TO ANY CONSTRUCTION, <br />IT COULD POSSIBLY CAUSE DAMAGE, <br />THE CHAIRMAN ASKED IF ANYONE IN THE AUDIENCE WISHED TO BE <br />HEARD, <br />GERMAN SUAREZ, DEVELOPER, STATED THAT THE MAIN REASON HIS <br />COMPANY PETITIONED FOR THIS CHANGE IS THAT R -1A LOTS ARE USUALLY 89 <br />X 125 OR 100 X 100, AND WITH A 25' FRONT SETBACK AND A 29' REAR SETBACK <br />THIS DOES NOT LEAVE ENOUGH ROOM FOR A SWIMMING POOL, HE NOTED THAT <br />THE CITY HAS HAD MUCH EXPERIENCE IN THIS SITUATION AND THEIR SETBACKS <br />WORK, HE ALSO POINTED OUT THAT IT IS VERY INCONVENIENT TO HAVE TO <br />CONTINUALLY APPEAR BEFORE THE VARIANCE BOARD IN THIS REGARD, AND HE <br />FELT IT WOULD BE MUCH WISER TO CHANGE THE nRDINANCE, <br />COMMISSIONER SIEBERT SUGGESTED HAVING PATIO CONSTRUCTION THE <br />SAME DISTANCE OFF THE PROPERTY LINE AS THE POOL, NOTING THAT IF IT IS <br />AN OPEN POOL YOU COULD HAVE A WALKWAY ONLY 5' FROM THE REAR LINE, HE <br />WAS CONCERNED THAT HEAVY EPUIPMENT ON THE EASEMENT COULD DAMAGE THE PATIO <br />AND 'THE COUNTY WOULD BE LIABLE, <br />CHAIRMAN 4ODTKE POINTED OUT THAT IF YOU HAVE A 15' EASEMENT, <br />THE 'POOL COULD BE RIGHT UP AGAINST THE EASEMENT, <br />DISCUSSION FOLLOWED IN REGARD TO CHANGING THE WORDING TO READ <br />THAT SWIMMING POOLS MAY BE ERECTED NO CLOSER THAN 10' FROM THE REAR <br />PROPERTY LINE, BUT NO CLOSER THAN 5' TO ANY EASEMENT, WHICHEVER IS <br />GREATER. <br />MR. SUAREZ ASKED THE ADMINISTRATOR WHAT HE FELT IS THE MINIMUM <br />WIDTH NEEDED. <br />ADMINISTRATOR J ENNINGS NOTED THAT IT IS NOT ONLY THE COUNTY <br />THAT USES THESE EASEMENTS, BUT FLORIDA POWER AND LIGHT, SOUTHERN BELL, <br />ETC., AND STATED THAT HE FELT 75% OF THE EASEMENTS IN THE COUNTY ARE <br />-INADEQUATE. <br />'COMMISSIONER SIEBERT FURTHER NOTED THAT IF YOU DO ALLOW CON- <br />STRUCTION RIGHT UP TO AN EASEMENT, YOU WILL HAVE PEOPLE LANDSCAPING THE <br />EASEMENT, WHICH CAUSES PROBLEMS, <br />ZONING DIRECTOR WALKER ASKED IN THE EVENT A SLAB IS POURED <br />30 <br />MAR 2 3 r9 77 �'k 29 <br />t „_ r t <br />
