NORTHERN BOUNDARY TO THE DOT FOR ROAD AND DRAI14AGE RIGHT-OF-WAY, <br />R <br />ATTORNEY STEWART STATED THAT A LETTER WAS WRITTEN -TO THE BOARD INDI- <br />CATING THERE WERE THREE ITEMS THE HOSPITAL WAS CONCERNED ABOUT IN <br />REGARD TO DONATING THIS PROPERTY" (1) THAT IF BARBER AVENUE WAS <br />NOT BUILT- THE PROPERTY WOULD REVERT TO THE HOSPITAL; (2) THAT <br />THE DRAINAGE WOULD BE SUFFICIENT FOR THEIR PURPOSES; AND (3) THAT <br />THE COUNTY GIVE THEM SOME ASSURANCE THE DRAINAGE FACILITY h1OULD BE <br />CONSTRUCTED BY THE COUNTY BEFORE THE"HOSPITAL WAS FINISHED, <br />ATTORNEY STEWART CG,iTINUED THAT IN NOVEMBER OF,1976, THEIR <br />ENGINEERS REVIEWED THE ROAD PLANS AND DETERMINED THE DRAINAGE MOULD <br />BE SUFFICIENT, AND IN JANUARY OF 1977 THE HOSPITAL'S DEED TO THE DOT <br />WAS GIVEN TO THE COUNTY TO BE DELIVERED WITH .THE ASSURANCE THAT THE <br />COUNTY WOULD BUILD THE DRAINAGE FACILITY. HE STATED THE WHOLE THEORY <br />BEHIND THIS WAS THAT THE DOT WANTED SOME ROAD RIGHT-OF-WAY AND FOR <br />AN EXCHANGE THEY MOULD INCORPORATE THE DRAINAGE INTO THE ROAD BUILDING. <br />ATTORNEY STEWART SAID HE UNDERSTANDS THERE IS NOW SOME PROBLEM RELATING <br />TO THE CONSTRUCTION OF THE DITCH BY THE COUNTY, AND HE IS HERE TO <br />DETERMINE WHAT THE HOSPITAL BOARD CAN EXPECT IN REGARD TO THIS <br />DRAINAGE FACILITY. <br />COMMISSIONER SIEBERT STATED THAT HE DID NOT UNDERSTAND WHERE <br />ANYONE EVER GOT THE IMPRESSION THAT BARBER AVENUE MIGHT NOT EVER BE <br />BUILT AS HE DOES NOT FEEL THERE WAS EVER ANY (QUESTION ABOUT IT. <br />COMMISSIONERLOY INFORMED ATTORNEY STEWART THAT THERE IS NO <br />QUESTION THAT THE DRAINAGE WILL BE BUILT; THE HOSPITAL MUST HAVE IT, <br />AND THE COUNTY NEEDS IT FOR THE ROAD, BUT THE QUESTION IS WHEN. SHE <br />NOTED THAT ONCE THE DEEDS ARE CLEARED AND WE HAVE THE RIGHT-OF-WAY, <br />IT WILL BE DONE, THE PROBLEM IS THAT THE COUNTY EQUIPMENT NOW IS <br />NEEDED FOR WORK ON THE LANDFILL SITE. <br />ADMINISTRATOR JENNINGS REVIEWED THE HISTORY OF 40W HE WORKED <br />WITH THE DOT OVER THE' LAST 2 YEARS TO' TR4'•TO ARRANGE SOME IHAY FOR <br />THIS DRAINAGE TO BE PROVIDED BY THE TIME'THE HOSPITAL OPENED, ASKING <br />THEM TO LET A MINI -CONTRACT AHEAD OF THE OVERALL ROAD CONSTRUCTION <br />FOR THIS PURPOSE,TO.WHICH THEY AGREED, AND ALSO ASKING IF WE COULD <br />TAKE COUNTY EQUIPMENT IPJ AND OPEN UP SOME KIND OF DITCH WHICH WAS <br />ALSO AGREED TO BY THE DOT AND THE BOARD, THE ADMINISTRATOR POINTED <br />OUT THAT HE NOW FEELS BECAUSE OF THE REQUIREMENTS OF -THE SANITARY <br />LANDFILL, THIS WORK MUST b3E DONE EITHER BY A MINI -CONTRACT OR THE <br />A <br />11AR 2 3 19 77 <br />
