U.S. t)EPAHT°AEN'f OF HOUSING AND URBAN DEVELOPMENT ASSURANCES The applicant hereby assures ar•.d certifies with respect to the grant that: (1) It pusws c, i",:,i authority to apply fur the grant, and to execute the proposed program, r (2) its governing body has duty adopted or passed as an offi fiat act a resolution, motion or similar action authorizing the filing of the application.' including all understandings and assurances contained therein, and directing and designating e the authorized n:prewnlative of the applicant to act in connection with the application and to provide such additional j information as may be required. (3) <'t has complied with all the requirements of 01(11 Circular No. A-95 as modified by Sections 570.300(c) (for i entitlement applicants) or 570.400(4) (for discretionary applicants) and that either i (f) any comments and recommendations made by or through clearinghouses are attached and have been considered prior to submission of the application; or (ht) the required procedures have leen followed and no comments or recommendations have been received. (4) Prior to submission of its application, the applicant has: ' I () provided citizens with adequate information concerning the amount of funds available for proposed community development and housing activities, the range of activities that may be undertaken, and other im�ortanl program requirements; i (ii) held at least two public hearings to obtain the views of citizens on community development and housing needs; and ; (iii) provided citizens an adequate opportunity to articulate needs, express preferences about propu6ed activities, assist in the selection of priorities, and otherwise to participate in the development of the application. i (5) Its chief executive officer or other officer of applicant approved by HUD: (i) Consents to assume the status of a responsible Federal official under the National Envircrueental Policy Act of 1969 insofar as the provisions of such Act apply to the applicant's proposed program pursuant to 24 CFR 570.603; and i (ii) is authorized and consents on behalf of the applicant and himself to accept the jurisdiction of the Federal courts I for the purpose of enforcement of his responsibilities as such an official. . I (6) The Community Development Program has been developed so as to give maximum feasible priority to activities which %ill benefit low or moderate income families or aid in the prevention or elimination of slums or blight. Where all or part of the community development program activities are designed to meet other community development needs having a particular urgency, such needs are specifically describe '-n the application under the Community Development Plan Summary. (7) It will comply with the re>_ulations. oolicics, guidelines and reou'uements of 1-ederal 1lanaeement f'irculars 74-4 and 74-7, as they relate to the application, acceptance and use of Federal funds for this federally -assisted program. (8) It will administer and enforce the labor standards requirements set forth in Section 570.605 and HUD regulations issued to implement such requirements. (9) It will comply with all requirements imposed by HUD concerning special requirements of law, program requirements, � and other administrative requirements approved in accordance with Federal Management Circular 74-7. (10) It will comply with the provisions of Executive Order 11296, relating to evaluation of (food hazards } • (11) It )till comply with: 1 t (1) Title VI of the Civil Rights Act of 1964 (P.L. 88-352) and the regulations issued pursuant thereto (24 CPR Part 1), which provides that no person in the United States shall on the ground of race, color, or national origin, be v excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any program or activity for which the applicant receives Federal financial assistance and will immediately take any i measures necessaryto effectuate this assurance.
