. i <br />r r . <br />U.S. t)EPAHT°AEN'f OF HOUSING AND URBAN DEVELOPMENT <br />ASSURANCES <br />The applicant hereby assures ar•.d certifies with respect to the grant that: <br />(1) It pusws c, i",:,i authority to apply fur the grant, and to execute the proposed program, r <br />(2) its governing body has duty adopted or passed as an offi fiat act a resolution, motion or similar action authorizing the <br />filing of the application.' including all understandings and assurances contained therein, and directing and designating e <br />the authorized n:prewnlative of the applicant to act in connection with the application and to provide such additional j <br />information as may be required. <br />(3) <'t has complied with all the requirements of 01(11 Circular No. A-95 as modified by Sections 570.300(c) (for i <br />entitlement applicants) or 570.400(4) (for discretionary applicants) and that either i <br />(f) any comments and recommendations made by or through clearinghouses are attached and have been considered <br />prior to submission of the application; or <br />(ht) the required procedures have leen followed and no comments or recommendations have been received. <br />(4) Prior to submission of its application, the applicant has: <br />' I <br />() provided citizens with adequate information concerning the amount of funds available for proposed community <br />development and housing activities, the range of activities that may be undertaken, and other im�ortanl program <br />requirements; <br />i <br />(ii) held at least two public hearings to obtain the views of citizens on community development and housing needs; <br />and ; <br />(iii) provided citizens an adequate opportunity to articulate needs, express preferences about propu6ed activities, <br />assist in the selection of priorities, and otherwise to participate in the development of the application. <br />i <br />(5) Its chief executive officer or other officer of applicant approved by HUD: <br />(i) Consents to assume the status of a responsible Federal official under the National Envircrueental Policy Act of <br />1969 insofar as the provisions of such Act apply to the applicant's proposed program pursuant to 24 CFR 570.603; and <br />i <br />(ii) is authorized and consents on behalf of the applicant and himself to accept the jurisdiction of the Federal courts I <br />for the purpose of enforcement of his responsibilities as such an official. <br />. I <br />(6) The Community Development Program has been developed so as to give maximum feasible priority to activities which <br />%ill benefit low or moderate income families or aid in the prevention or elimination of slums or blight. Where all or part <br />of the community development program activities are designed to meet other community development needs having a <br />particular urgency, such needs are specifically describe '-n the application under the Community Development Plan <br />Summary. <br />(7) It will comply with the re>_ulations. oolicics, guidelines and reou'uements of 1-ederal 1lanaeement f'irculars 74-4 and <br />74-7, as they relate to the application, acceptance and use of Federal funds for this federally -assisted program. <br />(8) It will administer and enforce the labor standards requirements set forth in Section 570.605 and HUD regulations <br />issued to implement such requirements. <br />(9) It will comply with all requirements imposed by HUD concerning special requirements of law, program requirements, � <br />and other administrative requirements approved in accordance with Federal Management Circular 74-7. <br />(10) It will comply with the provisions of Executive Order 11296, relating to evaluation of (food hazards } <br />• (11) It )till comply with: 1 <br />t <br />(1) Title VI of the Civil Rights Act of 1964 (P.L. 88-352) and the regulations issued pursuant thereto (24 CPR Part <br />1), which provides that no person in the United States shall on the ground of race, color, or national origin, be v <br />excluded from participation in, be denied the benefits of, or be otherwise subjected to discrimination under any <br />program or activity for which the applicant receives Federal financial assistance and will immediately take any i <br />measures necessaryto effectuate this assurance.
