7 <br />WILL BE MORE AND MORE SUBDIVISIONS COMING INTO THIS AREA, AND THEY MUST <br />HAVE DRAINAGE. ALL THAT BLOCKS THE DRAINAGE IS ONE LITTLE AREA, AND HE <br />IS LOOKING INTO THE POSSIBILITY OF OPENING UP AN OLD ROAD RIGHT-OF-WAY, <br />THE ADMINISTRATOR CONTINUED THAT THIS SUBDIVISION IS DRY NOW, BU': IF WE <br />GET INTO A HIGH FLOOD PERIOD, THERE WOULD BE A PROBLEM, <br />ATTORNEY COLLINS INQUIRED IN THE EVENT THE BOARD SHOULD APPROVE <br />THIS P,l_1T AND THESE SIX LOTS WERE DEVELOPED, WOULD THIS CAUSE ANY ADDITION- <br />AL HARMFUL AFFECT TO THE AREA. <br />ADMINISTRATOR JENNINGS STATED THAT HE DID NOT BELIEVE SO, BUT <br />NOTED THAT IF WE DON `T GET THE DITCH OPENED UP, HIGH WATER COULD AFFECT <br />THE SIX LOTS IN QUESTION'. <br />COMMISSIONER DEESON STATED THAT HE IS OPPOSET TO APPROVAL OF <br />MEIDEL SUBDIVISION DUE TO THE FACT THAT THERE ARE SIX POTENTIAL PROPERTY <br />OWNERS THAT COULD HAVE A PROBLEM, AND HE FELT WE POSSIBLY WOULD BE CREATING <br />SIX ADDITIONAL PROBLEMS. <br />ATTORNEY COLLINS BROUGHT UP THE POSSIBILITY OF CONDEMNATION. <br />SURVEYOR MUSICK POINTED OUT THAT MR. MEIDEL HAS FU�_FILLED HIS <br />OBLIGATIONS; HAS CUT HIS DITCHES; AND IS WILLING TO MAKE A STATEMENT THAT <br />THE COUNTY IS NOT RESPONSIBLE FOR THEIR MAINTENANCE. THE PROBLEM AREA IS <br />ABOUT HALF A MILE NORTH, HE WONDERED IF THE COUNTY HAS A LEGAL RIGHT TO <br />REFUSE THIS MAN, <br />ATTORNEY COLLINS STATED THAT THE COUNTY DOES HAVE THE RIGHT AS <br />THEY MUST CONSIDER VARIOUS ASPECTS AND THE AFFECT ON THE GENERAL PUBLIC. <br />THE ATTORNEY FELT THAT EVEN IF THE PLAT WERE NOT APPROVED, MR. MEIDEL COULD <br />DEVELOP THE LOTS AS THEY ARE EACH 100' LOTS AND ARE ON A DEDICATED STREET, <br />COMMISSIONER SCHMUCKER STATED THAT HE COULD SEE STOPPING DEVEL- <br />OPMENT IN THIS AREA FROM HERE ON OUT, BUT NOTED THAT WE HAVE PUT THIS MAN <br />IN A POSITION WHERE HE ALREADY HAS DONE ALL THIS WORK, <br />ADMINISTRATOR JENNINGS STATED THAT HE WOULD CONCUR THAT NO FUR- <br />THER;DEVELOPMENT BE CONSIDERED IN THIS AREA UNTIL SUCH TIME AS THE DRAIN- <br />AGE PROBLEM IS WORKED OUT, <br />COMMISSIONER SCHMUCKER FAVORED CONDEMNATION TO SOLVE THE PROBLEM. <br />COMMISSIONER DEESON AGREED THAT THE BOARD SHOULD CONSIDER CON- <br />DEMNATION AND NOT PENALIZE MR.
