RESOLUTION NO. 2008-115 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA, IN CONNECTION WITH THE "CITY OF <br />VERO UTILITY REFERENDUM" TO BE HELD IN CONJUNCTION WITH <br />THE GENERAL ELECTION OF NOVEMBER 4, 2008 <br />WHEREAS, On June 25, 2008, Governor Crist signed into law House Bill 7135, <br />Chapter 2008-227, that includes a provision for a question to be placed on the referendum <br />that would apply to the City of Vero Beach municipal utility ("Utility Authority Referendum"). <br />WHEREAS, The Utility Authority Referendum question to appear on the November <br />41 2008 ballot, pursuant to Florida Statutes section 366.04(7)(c)(2008) shall contain the <br />following language: <br />"Should a separate electric utility authority be created to operate the business of <br />the electric utility in the affected municipal electric utility? <br />Yes. No". <br />WHEREAS, The outcome of the Utility Authority Referendum will affect: (a) <br />residents within the City limits of the City of Vero Beach (herein "City Customers"); (b) <br />residents within the Town limits of Indian River Shores who receive electric, water and <br />sewer services from the City of Vero Beach (herein "Town Customers"); and (c) residents of <br />unincorporated Indian River County who receive electric, water and sewer services from the <br />City of Vero Beach (herein "County Customers"). <br />WHEREAS, based on information presented to the Board of County Commissioners <br />from time to time by various individuals, County Customers believe that they have no <br />elected or appointed representation with in the City of Vero Beach to address their concerns <br />and, therefore, have requested a resolution in support of the Utility Authority Referendum. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: <br />1. The Indian River County Board of County Commissioners ("Board") supports <br />having a Utility Authority Referendum. <br />2. The Board requests that the City Council of Vero Beach hold a Utility Authority <br />Referendum. <br />3. The Board requests that the Town Council of Indian River Shores support having <br />a Utility Authority Referendum. <br />4. The Board requests that the City Council of Vero Beach authorize, fund, and <br />actively engage in a public information and education program with respect to the <br />Utility Authority Referendum, so that the persons eligible to vote in the Utility <br />Authority Referendum are fully informed on the full effects of the Utility Authority <br />Referendum; and the County hereby commits fully and actively to work with the <br />City of Vero Beach in such public information and education program with <br />respect to the Utility Authority Referendum. <br />1 <br />
