WALKER ALSO NOTED THAT HE COULD <br />NOT SEEM TO GET ANY ACTION ON THIS MATTER FROM THE STATE'S ATTORNEY, <br />AND NOTED THAT IF THESE PEOPLE CONTINUE TO DELAY UNTIL THE FIRST OF <br />THE YEAR HOPING TO QUALIFY AS AGRICULTURAL, IT WILL ADD UP TO A SEVEN <br />MONTHS VIOLATION. <br />ATTORNEY COLLINS FELT THE BOARD SHOULD AUTHORIZE INJUNCTIVE <br />RELIEF. <br />ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY COMMISSIONER <br />SCHMUCKER, THE BOARD UNANIMOUSLY AUTHORIZED THE ATTORNEY TO PROCEED <br />WITH LEGAL ACTION AGAINST HARRY HEBERT AND E. J. LESCHINSKY IN REGARD <br />TO VIOLATION OF THE ZONING ORDINANCE. <br />ZONING DIRECTOR WALKER THEN INFORMED THE BOARD THAT JIM <br />RAYNOR WHO HAS VIOLATED THE ZONING ORDINANCE BY TURNING HIS YARD IN <br />THE ROCKRIGDE AREA INTO A JUNKYARD, HAS NOW BEEN SERVED WITH PAPERS <br />TO GO TO COUNTY COURT, AND SINCE THEN, HAS CLEANED UP HIS YARD CON- <br />SIDERABLY. MR. WALKER CONTINUED THAT ANOTHER PROBLEM HAS ARISEN WITH <br />A MR.LAMBERT IN COUNTRY CLUB POINT WHO IS USING HIS PROPERTY THERE <br />FOR TRAILER REPAIR AND RENTAL IN VIOLATION OF THE ZONING ORDINANCE. <br />HE INFORMED THE BOARD THAT HE HAS HAD NO REPORT FROM THE STATE'S <br />ATTORNEY ON THIS MATTER IN SIX WEEKS. <br />COMMISSIONER Loy SUGGESTED THAT THE CHAIRMAN BE AUTHORIZED <br />TO DISCUSS THIS PROBLEM OF SLOW ACTION WITH THE STATE'S ATTORNEY IN <br />AN EFFORT TO GET THESE MATTERS EXPEDITED. THE BOARD AGREED, <br />COMMISSIONER SIEBERT QUESTIONED THE ZONING DIRECTOR ABOUT THE <br />ENFORCING OF THE MINING ORDINANCE, AND MR. WALKER STATED THAT THEY <br />VISIT AND MONITOR THESE OPERATIONS. HE NOTED THAT MINING OPERATIONS <br />LOOK TERRIBLE, AND UNLESS THEY GO EVERY WEEK AND RUN A GRADE, THEY <br />CAN IT CONTROL THEM. HE STATED THAT THE OPERATORS HAVE SUBMITTED RE- <br />PORTS IN OCTOBER AS REQUIRED. MR. WALKER INFORMED THE BOARD THAT <br />MRS 'JENKINS IS BACKFILLING> AS SET OUT IN HIS AGREEMENT BUT THAT THE <br />BANK WHO HOLDS THE MORTGAGE DOES NOT WISH HIM TO REMOVE THE RACETRACK. <br />COMMISSIONER LOY FELT THE ATTORNEY SHOULD CHECK WITH THE <br />BANK IN REGARD TO THE RACETRACK SITUATION. <br />DISCUSSION CONTINUED WITH REGARD TO VARIOUS MINING OPERA= <br />TIONS, AND COMMISSIONER SIEBERT COMMENTED THAT RESTORATION OF THESE <br />14 <br />CT 5 1977 <br />m <br />JL PAGE <br />I <br />
