Taos <br />( HOUSE BILL NO. 1044 <br />AN ACT Prohibiting the Taking of or Attempting to Tale F;sh, <br />i Except 'With Hook and Line, in the Channel of the Indian <br />River in Indian River County, Florida, or Within One IIun- <br />dred Feet on Each Side of Said Channel; Proh'biling the. <br />Use of Net-, Seines and Other Devices in Said Waters of <br />Said Arca; Defining the Terms "Channel" amt Other Tereus <br />Set Out in Said Act; Providing Penalties for the Violation <br />of Sdid Act and Providing for the Enforcement Thereof. <br />i Be It Evacted by the Legislature of the State of Florida: <br />Section 1. For the purpnse of this Act, the following terms <br />shall be construed respectively to mean: <br />{ PERSON. The plural or singular, as the case demamis, in - <br />eludes individuals, associations, partnership, and corporations, <br />unless the context should otherwise require. <br />i <br />TAKE. \Vhecever it is made unlawful to "take" fish, the <br />j word "take" shall include pursuing, killing, capturing, tral,pim, <br />snaring, netting, gigging and worrying a fish, or attempting so <br />to do, or placing or using any net, trap, snare, seine or other <br />device for the purpo-e of taking same and whether or not such <br />act or acts result in taking such fish. <br />- "Iu the chancel of the Indian River, in Indian River County, <br />Florida, or Avithin one hundred feet on each side of said channel" <br />is for the purposes of this Act herewith defined to be, and this Act <br />shall be so construed, all waters within the navigable channel of <br />the Indian River in Indian Riyer County, Florida, and which navi- <br />gable channel is a part of the inland waterways, and which said <br />navigable channel is located by buoys or other ni.arkerit placed <br />by the United States Engineers together with the area extendinn <br />a distance of one hundred feet from each side of said channel <br />in a direction away from , the center of such channel and the <br />tsides of which channel being as determined and marked by the <br />buoys and markers placed by United States Engineers. <br />Section 2. It shall be unlawful for any person to take or at- <br />tempt to take fish, except with book and line, in the channel <br />of the Indian River in Indian River County, Florida; and within <br />one hundred feet on each side of said channel. <br />0V 21977 BOOK 31 pAr <br />
