WASHBURN FEELS THIS IS DE- <br />VALUATING HIS RESIDENTIAL PROPERTY. <br />ATTORNEY O'NEILL CALLED CHARLES ZIMMER FORWARD, <br />CHARLES HARRISON ZIMMER STATED THAT IN 1968 OR 1969 HE RENTED <br />A COTTAGE FROM MR. WASHBURN AND SPENT ABOUT FOUR MONTHS LIVING ON THE. <br />WASHBURN PROPERTY, HE INFORMED THE BOARD THAT AT THAT TIME, PARS. CRUZE <br />WAS RESIDING IN A TRAILER AND THERE WERE A NUMBER OF PLANTS SHE TOOK <br />CARE OF DAILY, BUT HE DID NOT KNOW WHETHER SHE WAS SELLING THEM OR NOT. <br />HE STATED THAT PLANTS WERE IN A SMALL AREA, JUST ADJACENT AND AROUND HER <br />TRAILER, AND THERE WERE NO SIGNS, ETC. <br />ATTORNEY CHARLES SULLIVAN APPEARED REPRESENTING NIRS. CRUZE AND <br />INFORMED THE BOARD THAT MR. AND NIRS. CRUZE PURCHASED THE PROPERTY IN <br />1950, HE CONTINUED THAT MRS. CRUZE HAS BEEN GROWING PLANTS THERE AND <br />SELLING THEM SINCE 1951 IN ORDER TO SUPPORT HERSELF, WHICH CAN BE <br />VERIFIED BY HUNDREDS OF PEOPLE IN THE COUNTY, ATTORNEY SULLIVAN POINTED <br />OUT THAT THERE ARE NOW 19 HOUSES BUILT IN THIS SUBDIVISION ON THE PROPERTY <br />THAT FORMERLY BELONGED TO MRS, CRUZE. HE NOTED THAT WHEN ALL THESE PEOPLE <br />PURCHASED THESE LOTS, THE NURSERY WAS A COMMERCIAL OPERATION, AND HE <br />FEELS IT IS LEGALLY ENTITLED TO REMAIN THERE, ATTORNEY SULLIVAN CONTINUED <br />THAT NIRS. CRUZE HAS NOT EXPANDED THE AREA, BUT HAS EXPANDED THE MERCHAN- <br />DISE -WITHIN THE AREA. <br />ATTORNEY COLLINS ASKED WHETHER MRS. CRUZE. AT ANY TIME WAS <br />SELLING PLANTS IN CONFORMITY WITH THE EXISTING ORDINANCE. <br />ATTORNEY SULLIVAN STATED THAT MRS. CRUZE WAS SELLING PLANTS <br />BEFORE THERE WAS ANY ZONING IN THE COUNTY, AND, THEREFORE, THEY FEEL IT <br />IS A NON -CONFORMING USE, <br />ADMINISTRATOR .JENNINGS STATED THAT HE IS FAMILIAR WITH THIS <br />MATTER AND HE PERSONALLY PURCHASED PLANTS FROM MRS. CRUZE BACK IN THE <br />50'S. IN REGARD TO BLOCKING INGRESS AND EGRESS TO THE WASHBURN PROPERTY <br />OVER THE DRAINAGE DISTRICT ROAD, HE INFORMED THE BOARD THAT -BACK THEN <br />THERE VAS NO ROAD ON THE EAST SIDE OF THIS PROPERTY, AND WHEN MR. <br />WASHBURN'S PRESENT HOME WAS BUILT, YOU ENTERED THE PROPERTY FROM THE WEST, <br />THE ADMINISTRATOR CONTINUED THAT HE.CAN UNDERSTAND THE 14ASHBURNS' FEELINGS <br />AS THIS IS A RESIDENTIAL AREA, AND NOT COMMERCIAL, BUT HE POINTED OUT <br />H <br />
