ZONING DIRECTOR WALKER POINTED OUT THAT THIS PROPERTY WAS <br />ORIGINALLY ZONED R-1 AND THEN WHEN THE ROUTE EO STUDY WAS DONE, IT WAS <br />REZONED TO AGRICULTURAL. <br />MOTION WAS MADE BY COMMISSIONER SIEBERT, SECONDED BY COMMIS- <br />SIONER DEESON, TO GRANT THE SPECIAL EXCEPTION AS REQUESTED BY ROBERT <br />AND WENDY MCIVER. <br />CHAIRMAN WODTKE STATED THAT HE WILL VOTE FOR THE LOTION, BUT <br />FELT IT IS THE CONCURRENCE OF THIS BOARD THAT THEY STRONGLY RECOMMEND <br />THE PROPERTY BE SUBDIVIDED FOR THE BENEFIT AND PROTECTION OF MR. MCIVER <br />AND ALL THE PROPERTY OWNERS AND THAT IT IS VERY NECESSARY TO GET PROPER <br />RIGHT-OF-WAY SET ASIDE IMMEDIATELY TO AVOID FUTURE PROBLEMS, <br />COMMISSIONER SCHMUCKER STATED THAT HE WILL HAVE TO VOTE <br />AGAINST THE MOTION BECAUSE HE FEELS IT ACTUALLY IS A DISSERVICE TO <br />MR, MCIVER AND HE MAY VERY WELL REGRET IT IN THE FUTURE. <br />THE CHAIRMAN CALLED FOR THE QUESTION. COMMISSIONERS DEESON <br />AND SIEBERT AND CHAIRMAN WODTKE VOTED IN FAVOR. COMMISSIONER SCHMUCKER <br />VOTED IN OPPOSITION. THE flOTION CARRIED. <br />JAMES BEINDORF, ENGINEER, CAME BEFORE THE BOARD REPRESENTING <br />VICTOR KNIGHT AND ASKING FOR FINAL APPROVAL OF BRIARWOOD SUBDIVISION. <br />DISCUSSION FOLLOWED IN REGARD TO DRAINAGE PROBLEMS IN THIS <br />AREA, AND THE BOARD REVIEWED THE MINUTES OF THE MEETINGS OF APRIL ETH <br />AND .TUNE STH, 1977, WHERE THIS WAS DISCUSSED. THIS PROPERTY, FORMERLY <br />KNOWN AS BOUGAINLEA SUBDIVISION, WAS ORIGINALLY DIVIDED UP INTO NUMEROUS <br />SMALL LOTS, EACH HAVING A.5' REAR LOT LINE EASEMENT, IT WAS LATER RE - <br />SUBDIVIDED INTO TWO TRACTS OF APPROXIMATELY S ACRES EACH, AND RELEASE <br />OF ALL THE ORIGINAL 5' REAR LOT LINE EASEMENTS WAS APPROVED, CONTINGENT <br />ON THE GIVING OF A 5' EASEMENT ON THE EAST SIDE OF THE PROPERTY FROM <br />THE NORTH PROPERTY LINE TO THE SOUTH PROPERTY LINE. AT THE MEETING OF <br />.JUNE 8, 1977, MR, KNIGHT INFORMED THE BOARD THAT THEY HAD GIVEN AN <br />ADDITIONAL 50' EASEMENT, WHICH WOULD TAKE CARE OF -ANY DRAINAGE PROBLEMS. <br />THE RELEASE OF EASEMENT WAS NEVER PREPARED AND RECEIVED FOR RECORDING, <br />BUT ATTORNEY COLLINS FELT THIS WOULD NOT AFFECT APPROVAL OF THE FINAL <br />PLAT. <br />ON MOTION BY COMMISSIONER SCHMUCKER, SECONDED BY COMMISSIONER <br />DEESON, THE BOARD UNANIMOUSLY GRANTED FINAL APPROVAL OF BRIARWOOD SUB- <br />DIVISION. <br />49 <br />FEB 2 21978 BooK34 Ao 9 <br />
