RESOLUTION NO.2013- 129 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, URGING THE FLORIDA LEGISLATURE TO <br />ADOPT AND THE GOVERNOR RICK SCOTT TO <br />SUPPORT LEGISLATIVE CHANGES PROVIDING THE <br />ABILITY FOR LOCAL GOVERNMENTS TO REGULATE <br />VACATION RENTALS, DIRECTING CERTIFIED COPIES <br />OF THIS RESOLUTION TO BE PROVIDED TO VARIOUS <br />OFFICIALS, ORGANIZATIONS AND CITIES. <br />WHEREAS, Florida Statute Section 509.032(7)(b) preempts local regulation of vacation <br />rental units; and <br />WHEREAS, maintenance of the character and integrity of residential neighborhoods is <br />an essential local government purpose implemented through local zoning regulations, <br />representing a substantial local governmental interest; and <br />WHEREAS, the Board of County Commissioners (hereinafter the "Board") finds local <br />government autonomy to regulate vacation rentals will contribute to the stability of existing <br />residential neighborhoods, and therefore requests that the Florida Legislature end the preemption <br />and return its full home rule powers to determine whether to amend or expand its vacation rental <br />regulations in the future; and <br />WHEREAS, Senator Thrasher has filed Senate Bill 356 for consideration during the <br />2014 Session of the Florida Legislature, deleting the restriction preventing local laws, <br />ordinances, or regulations from regulating the use of vacation rentals based solely on their <br />classification, use, or occupancy; and <br />WHEREAS, the Board finds the ability for local governments to independently regulate <br />vacation rentals will offer the best avenue to address each community's specific regulatory needs <br />in order to protect the health, safety and welfare of its residents, both permanent and temporary; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, THAT: <br />Section 1. The above "WHEREAS" clauses are true an <br />d correct, and are hereby adopted <br />as findings of the Board. <br />Section 2. The Board urges the State Administration and Florida Legislature to support <br />SB 356 and any other legislation that restores the ability of local governments to provide for <br />regulation and zoning of Vacation Rentals. <br />Page 1 of 2 <br />
