ON MOTION BY COMMISSSIONER SIEBERT, SECONDED BY COMMIS- <br />SIONER DEESON, THE BOARD UNANIMOUSLY AUTHORIZED THE ADMINISTRATOR <br />TO PROFILE THE EASEMENT ON MR. METCALF'S PROPERTY IN RIVENBARK <br />SUBDIVISION, AND, IF, IN HIS DETERMINATION, THE ONLY WAY TO SOLVE <br />THE DRAINAGE PROBLEM IS TO INCREASE THE EASEMENT, THAT WE REQUEST <br />MR. METCALF TO ASSIST IN PROCURING THE NEEDED EASEMENT, AND IF IT <br />CAN BE SOLVED, THAT WE PROCEED WITH THE NECESSARY ACTION. <br />ATTORNEY COLLINS REQUESTED THAT THE BOARD NOW AUTHORIZE <br />RELEASE OF THE CASH BOND FOR LAURELWOOD, UNIT 21 SINCE THE LEGAL <br />HURDLES HE HAD MENTIONED EARLIER HAVE BEEN OVERCOME. <br />ON MOTION BY COMMISSIONER DEESON, SECONDED BY COMMISSIONER <br />SIEBERT, THE BOARD UNANIMOUSLY APPROVED RELEASE OF STREET AND DRAIN- <br />AGE MAINTENANCE BOND FOR LAURELWOOD, UNIT 2, IN THE AMOUNT OF $5,400.00, <br />SUBJECT TO APPROVAL OF THE ATTORNEY AND THE ADMINISTRATOR. <br />ATTORNEY COLLINS NEXT DISCUSSED WITH THE BOARD THE WASHBURN- <br />CROZE ZONING VIOLATION COMPLAINT WHICH WAS REFERRED TO HIM FOR <br />RECOMMENDATION PRIOR TO ANY FINAL ACTION BY THE BOARD, <br />ATTORNEY COLLINS STATED THAT THE FOLLOWING FACTS EXIST: <br />(1) MRS. CRUZE WAS OPERATING A COMMERCIAL ENTERPRISE PRIOR TO THE <br />ZONING CHANGE WHICH MADE IT A NON -CONFORMING USE. <br />(2) IN THE OPERATION OF THAT COMMERCIAL ENTERPRISE SHE WAS NOT ONLY <br />RAISING AND SELLING PLANTS, BUT SHE WAS IMPORTING AND SELLING PLANTS. <br />(3) AERIALS OF THE PROPERTY AT A TIME CLOSE TO WHEN SHE BEGAN HER <br />OPERATION HAVE BEEN CHECKED AS WELL AS THE MOST CURRENT AERIALS, AND <br />IT APPEARS THAT SHE IS OPERATING HER BUSINESS WITHIN THE SAME FRAME <br />OF PROPERTY; ALTHOUGH, THE AERIALS INDICATE A GREAT INTENSIFICATION <br />OF THE COMMERCIAL ENTERPRISE. <br />(4) AT THE TIME THE ORIGINAL COMPLAINTS WERE FILED AND THROUGH <br />UNTIL TWO TO THREE WEEKS AGO, MRS. CRUZE WAS OPERATING HER COMMERCIAL <br />ENTERPRISE WITH EXTENDED USES BY.OPERATING ON THE DRAINAGE RIGHT- <br />OF-WAY AND SELLING OTHER RELATED PRODUCTS, PARTICULARLY FERTILIZER. <br />ATTORNEY COLLINS INFORMED THE BOARD THAT ACCORDING TO LAW, <br />EXTENSIONS OF A NON -CONFORMITY ARE NOT ALLOWABLE AND EXPANSIONS OF A <br />NON -CONFORMITY CREATE VIOLATIONS, BUT AN It INTENSIFICATION It OF A. <br />16 <br />MAR 2 2197 <br />BOOK - 31 FADE x..37 <br />
