0 <br />w <br />ADMINISTRATOR .JENNINGS INFORMED THE BOARD THAT IN EXCAVATION <br />OF THE BORROW AREA THEY HAVE COME TO A LAYER OF VERY HARD MATERIAL THAT <br />-THE PRESENT DRAGLINE BUCKET WILL NOT CUT, AND THEY, THEREFORE, NEED A <br />ROCK BUCKET, WHICH IS A VERY HEAVY BUCKET ESPECIALLY DESIGNED TO CUT <br />INTO HARD MATERIAL. HE CONTINUED THAT THEY HAVE RECEIVED THREE PRO- <br />POSALS ON A ROCK BUCKET, AND THE LOWEST ONE IS FROM MOODY & SONS, INC., <br />OF TAMPA FOR $3,086.00 PLUS FREIGHT OF $180.00. ADMINISTRATOR .JENNING <br />NOTED THAT THIS ITEM COULD BE PUT OUT FOR BID, BUT THE PROBLEM 1S TIME <br />AS HE CONSIDERS THIS AN EMERGENCY SITUATION. <br />ON MOTION BY COMMISSIONER SCHMUCKER, SECONDED BY COMMISSIONER <br />DEESON, THE BOARD UNANIMOUSLY DECLARED AN.EMERGENCY SITUATION AT THE <br />LANDFILL AND AUTHORIZED THE ADMINISTRATOR TO PURCHASE A HENDRIX "HS" <br />ONE CUBIC YARD DRAGLINE ROCK BUCKET FROM MOODY & SONS, INC., OF TAMPA, <br />AS PER THEIR PROPOSAL OF $3,O86.00, PLUS FREIGHT AND SALES TAX; THIS <br />AMOUNT TO BE PAID OUT OF THE LANDFILL FUNDS. <br />ATTORNEY COLLINS DISCUSSED WITH THE BOARD THE PROPOSED SITE <br />PLAN ORDINANCE AND REQUESTS BY LOCAL ARCHITECTS FOR COMPLIANCE WITH <br />FLORIDA STATUTE 467.09 WHICH RELATES TO THE REQUIREMENT THAT AN ARCHI- <br />TECT OR AN ENGINEER PREPARE DESIGNS OR PLANS THAT BASICALLY INVOLVE <br />ANYTHING OTHER THAN SINGLE FAMILY OR DUPLEX HOMES OR STRUCTURES COSTING <br />LESS THAN $5,000. THEY FEEL A PROFESSIONAL SEAL IS NEEDED ON ALL <br />SITE PLAN APPROVAL DRAWINGS. THE ATTORNEY INQUIRED WHETHER THE BOARD <br />WISHED SUCH COMPLIANCE TO BE INCLUDED IN THE PROPOSED SITE PLAN ORDI- <br />NANCE. <br />COMMISSIONER SIEBERT FELT WE DO NOT HAVE MUCH CHOICE. <br />ATTORNEY COLLINS STATED HE FELT THAT WE DO, BUT ALSO NOTED <br />THAT HE FEELS THIS WILL -IMPROVE THE SITE PLANS THAT DO COME BEFORE THE <br />COUNTY AND WILL INSURE COMPLIANCE. <br />COMMISSIONER SIEBERT POINTED OUT THAT YOU HAVE TO HAVE A SITE <br />PLAN TO PUT UP A FENCE. <br />ATTORNEY COLLINS FELT THE STATUTE AIMS PRIMARILY AT BUILDINGS <br />AND POINTED OUT THAT IT WOULD ONLY APPLY TO ANYTHING'COSTING OVER $5,000. <br />THE ATTORNEY NOTED THAT THE STATUTE IS IN'THE ARCHITECTURAL SECTION, <br />BUT POINTED OUT THAT IT EXCLUDES ALL WORK DONE BY ENGINEERS AND HE <br />FELT AN ENGINEER WOULD BE IN COMPLIANCE.
