t <br />. <br />THE QUESTION AROSE AS TO WHO WILL PAY THE COST OF PAVING <br />THE HALF STREET ON THE NORTH OF LOT 17 WHEN THE PROPERTY DEVELOPS <br />IN THE FUTURE, <br />ADMINISTRATOR JENNINGS FELT THE DEVELOPER WOULD BE RE- <br />QUIRED TO CONTINUE IT ACROSS AND THAT IT IS NOT THE COUNTY'S RESPONSI- <br />BILITY, <br />MR. LUETHJE POINTED OUT THAT THEY ARE PAVING HALF OF THE <br />STREET IN THE EXISTING RIGHT-OF-WAY, AND HE FELT WHOEVER DEVELOPS <br />THE OTHER PROPERTY IN THE FUTURE WOULD BE THE ONE TO PAVE THE REMAIN- <br />ING HALF STREET. <br />IN FURTHER DISCUSSION, IT WAS AGREED THE 20' STRIP WAS MORE <br />PRACTICAL THAN PUTTING IN THE HALF STREET. <br />ON MOTION BY COMMISSIONER SCHMUCKER, SECONDED BY COMMISSIONER <br />DEESON, THE BOARD UNANIMOUSLY GRANTED TENTATIVE APPROVAL TO WINTER <br />BEACH PARK SUBDIVISION, <br />ZONING DIRECTOR, DEWEY WALKER, CAME BEFORE THE BOARD IN <br />REGARD TO A RELEASE OF EASEMENTS BETWEEN LOTS 11 AND 12, BLOCK 2, <br />ICINGS MUSIC LANDS SUBDIVISION, REQUESTED BY JOE AND LOLA RUSSELL. <br />HE EXPLAINED THAT THEY WANT TO ADD ONTO THEIR RESIDENCE AND BUILD <br />ACROSS THE EASEMENTS, MR. WALKER NOTED THAT HE HAS HAD OTHER SIMILAR <br />REQUESTS IN THE AREA,AND THIS IS A ROUTINE SITUATION, <br />ON MOTION BY COMMISSIONER SIEBERT, SECONDED BY COMMISSIONER <br />SCHMUCKER, THE BOARD UNANIMOUSLY ADOPTED RESOLUTION N0. 75-19 APPROV- <br />ING RELEASE OF EASEMENT BETWEEN LOTS.11 AND 12, BLOCK 2, KINGS MUSIC <br />LANDS -SUBDIVISION AS REQUESTED BY JOE AND-LOLA RUSSELL AND AUTHORIZED <br />THE CHAIRMAN'S SIGNATURE TO THE DOCUMENTS, WHICH ARE TO BE PREPAR-ED <br />AT THE EXPENSE OF THE APPLICANT, <br />-ADMINISTRATOR JENNINGS INFORMED THE BOARD THAT LAUREL <br />BUILDERS ARE REQUESTING RELEASE OF THEIR CASH BOND AND ACCEPTANCE <br />OF THE SUBDIVISION IMPROVEMENTS WHICH ARE NOW COMPLETED, HE STATED <br />THAT EVERYTHING IS IN ORDER AND HE HAS NO OBJECTION TO THE RELEASE <br />OF THE CASH BOND.. <br />ATTORNEY COLLINS NOTED JHAT FROM A LEGAL STANDPOINT, HE HAS <br />SOME DIFFICULTY WITH THE RELEASE OF THE CASH BOND, WHICH HE FEELS CAN <br />BE OVERCOME BY THE NEXT MEETING,- HE, THEREFORE, SUGGESTED THE BOARD <br />ACCEPT THE PLAT TODAY BUT HOLD OFF APPROVING RELEASE OF THE CASH BOND <br />6 <br />MAR 2 2 197 <br />Boa 34**'E127 <br />
