I'lY <br />ASSISTANT PLANNER BERG INFORMED THE BOARD THAT THIS PROPERTY <br />IS LOCATED ON THE EXTREME WESTERN FINGER OF MOORING LANE DRIVE AND <br />COVERS LOTS 120 THROUGH 124. HE NOTED THAT SITE PLAN APPROVAL HAS <br />BEEN GIVEN FOR SEVERAL MULTIPLE FAMILY DEVELOPMENTS IN THIS AREA, <br />WHICH IS RAPIDLY BECOMING DEVELOPED IN A MEDIUM DENSITY TYPE OF <br />USE. MR. BERG CONTINUED THAT PART OF THE PROPERTY IS ZONED <br />PROPERLY FOR THIS AND PART STILL IS NOT, BUT THE BOARD IN ORDER TO <br />J. <br />SETTLE A COURT CASE RECENTLY AUTHORIZED THE ATTORNEY TO SIGN A <br />$TIPULiATION, WHICH IS BASED ON PROPER ZONING BEING OBTAINED. <br />DISCUSSION FOLLOWED ON THE FACT THAT THE NOTICE COVERS LOTS <br />120 THROUGH 125 AND NOT 120 THROUGH 124 AS STATED BY MR, BERG. <br />MR. BERG EXPLAINED THAT THERE WAS A PROBLEM ABOUT GETTING <br />PROPER NOTICE TO THE OWNER OF LOT 125 BECAUSE OF A CHANGE IN THE <br />TAX ROLL AND THEY, THEREFORE, WITHDREW LOT 125 FROM THIS HEARING. <br />MR. BERG CONTINUED THAT THE MASTER PLAN INDICATES THIS AREA AS <br />MEDIUM DENSITY, AND THE $ITE PLANS THAT HAVE BEEN'GIVEN APPROVAL <br />ALSO REFLECT THIS DENSITY. HE INFORMED THE BOARD THAT THE <br />PLANNING STAFF RECOMMENDS THIS REZONING AND HAD RECOMMENDED THAT <br />LOT 120 THROUGH 125 BE INCLUDED TO ELIMINATE ANY COMMERCIAL <br />DISTRICT, WHICH IS NOT COVERED IN THE MASTER PLAN. <br />RICHARD ALLEN WAS PRESENT REPRESENTING THE MOORINGS <br />DEVELOPMENT CORPORATION AND STATED HE HAD NOTHING TO ADD. <br />THE CHAIRMAN ASKED,IF ANYONE PRESENT WISHED TO BE HEARD. <br />THERE WERE NONE. <br />ON MOTION BY COMMISSIONER DEESON, SECONDED BY COMMISSIONER <br />SIEBERT, THE BOARD UNANIMOUSLY CLOSED THE PUBLIC HEARING. <br />ON -MOTION BY COMMISSIONER DEESON, SECONDED BY COMMISSIONER <br />Loy, THE BOARD UNANIMOUSLY ADOPTED ORDINANCE 78-12 GRANTING THE <br />REZONING TO R -2C AS REQUESTED BY THE APPLICANTS. <br />43 <br />BOOK 34 PAGF 4 ! <br />
