ASSISTANT PLANNER BERG INFORMED THE BOARD THAT THIS <br />PROPERTY IS LOCATED AT THE NORTHWEST CORNER OF 74TH AVENUE AND <br />16TH STREET AND CONTAINS APPROXIMATELY 30 ACRES. THERE IS AN <br />EXISTING LAKE ON THE PROPERTY WHICH WAS DUG QUITE SOME TIME <br />AGO. MR. BERG NOTED THAT THIS REZONING REQUEST ALSO INVOLVES <br />THE NEXT REQUEST ON THE AGENDA WHICH IS FOR TENTATIVE APPROVAL <br />OF A SUBDIVISION. HE CONTINUED THAT THE EXISTING ZONING AROUND <br />THIS PROPERTY IS AGRICULTURAL. THE COMPREHENSIVE PLAN SHOWS <br />AGRICULTURAL, AND THE PLANNING STAFF HAS RECOMMENDED R-lE AS <br />BEING IBJ KEEPING WITH THE AGRICULTURAL USE INASMUCH AS IT PROVIDES <br />FOR ONE UNIT PER ACRE, WHICH IS LOW DENSITY, MR, BERG BRIEFLY <br />REVIEWED THE PLAN OF THE PROPOSED SUBDIVISION. <br />COMMISSIONER SCHMUCKER STATED THAT HE IS FAMILIAR WITH THIS <br />PROPERTY, WHICH WAS ORIGINALLY STRIPPED FOR MINING PURPOSES AND <br />IS VERY LOW LAND, <br />DEAN LUETHJE OF CARTER ASSOCIATES CAME BEFORE THE BOARD <br />REPRESENTING THE WILMOTHS AND MR,. BERGAMINO AND STATED THAT THERE <br />IS EXISTING FILL THERE THAT WILL BE MOVED AROUND. HE NOTED THAT <br />THEY DID RECEIVE APPROVAL FROM THE ZONING COMMISSION WITH THE <br />PROVISION THAT THEY INCLUDE IN THEIR DEED RESTRICTIONS A <br />NOTIFICATION TO FUTURE OWNERS OF THE LOTS THAT THEY WOULD BE <br />WITHIN AN EXISTING AGRICULTURAL AREA AND COULD NOT OPPOSE IT IN <br />THE FUTURE. MR. LUETHJE STATED THAT THIS WILL BE DONE. HE POINTED <br />OUT THAT THEY ORIGINALLY ASKED FOR R-lA, BUT CHANGED THEIR REQUEST <br />ti TO R-lE ON THE RECOMMENDATION OF THE PLANNING DEPARTMENT. <br />THE CHAIRMAN ASKED IF ANYONE PRESENT WISHED TO BE HEARD. <br />AUTRY THOMAS INFORMED THE BOARD THAT HE HOLDS TITLE TO <br />THE 10 ACRES IMMEDIATELY NORTH OF THIS PROPERTY, HE STATED THAT <br />THE SOUTHERN HALF OF HIS PROPERTY IS ZONED AGRICULTURAL AS IS ALL <br />THE PROPERTY ADJACENT TO THE SUBJECT PROPERTY, AND THE ONLY .PART <br />OF THIS SURROUNDING PROPERTY WHICH IS NOT IN GROVES AND AGRICULTURAL <br />USE IS WHERE THE FOUR FAMILIES REPRESENTED HERE TODAY LIVE. MR. <br />THOMAS STATED THAT HE LIVES IN THE COUNTRY FOR THE EXPRESS PURPOSE <br />OF HAVING LOW DENSITY AND WOULD CONSIDER IT AN ENCROACHMENT ON <br />47 <br />MAY 10 1976 34 <br />
