a <br />ATTORNEY COLLINS EXPLAINED THAT THE ZONING COMMISSION ON <br />ITS OWN MOTION HAS THE RIGHT TO HOLD HEARINGS AND TO RECOMMEND <br />REZONING TO THE BOARD, AND HE DOES NOT FEEL THE BOARD CAN ACT ON <br />THIS MATTER UNTIL IT IS PROPERLY BEFORE THEM FOR CONSIDERATION. <br />MR. BERG STATED THAT THE AREA MR. SORENSEN IS TALKING ABOUT <br />IS NOT A MASTER PLAN CHANGE, BUT IS PART OF THE REZONING PROCESS. THE <br />ZONING COMMISSION HAS ALREADY HAD A HEARING AND MADE A RECOMMENDATION <br />AND IT WILL COME BEFORE THE BOARD AS SOON AS THEY GET THE NOTIFICATIONS <br />WORKED OUT. <br />COMMISSIONER SIEBERT ASKED HOW WE COULD WITHDRAW A PIECE OF <br />PROPERTY FROM A REZONING BEFORE A PUBLIC HEARING, AND ATTORNEY COLLINS <br />FELT THIS COULD NOT BE DONE BEFORE THE HEARING IS PROPERLY ADVERTISED. <br />MR. SORENSEN THEN ASKED WHEN THE PUBLIC HEARING WOULD BE. <br />HE DID NOT UNDERSTAND WHY THERE SHOULD BE ANY PROBLEM WITH NOTIFICATION <br />WHEN THE ZONING COMMISSION HAD ALREADY HELD ONE HEARING. <br />MR. BERG POINTED OUT THAT THAT HEARING WAS ADVERTISED BY <br />A MAP'OF THE AREA AND THEY DID NOT SEND OUT INDIVIDUAL NOTICES. <br />CHAIRMAN WODTKE ASKED MR. BERG IF HE WAS SAYING THAT THERE IS <br />TO BE A HEARING INSTIGATED BY THE ZONING DEPARTMENT TO BRING LAND ALONG <br />S.R. 512 INTO CONFORMANCE WITH THE MASTER PLAN AND THAT HEARING WILL <br />ADDRESS ITSELF NOT ONLY TO THE GULF & WESTERN PROPERTY BUT ALL THE <br />PROPERTY ALONG THAT ROAD, WHICH NOW IS ZONED C-1. MR. BERG AGREED. <br />COMMISSIONER LOY NOTED THAT EXCEPT FOR BAD PUBLIC RELATIONS, <br />THERE IS NO REASON THAT GULF & WESTERN COULDN'T GO OUT NOW AND DO <br />WHAT THEY WANTED TO DO WITH THEIR PROPERTY. SHE POINTED OUT THAT THE <br />PUBLIC HEARING HELD BY THE ZONING COMMISSION WAS IN SEPTEMBER OF <br />1977. SHE ASKED IF IT IS RECOMMENDED THAT COMMERCIAL ZONING BE LEFT <br />ON THE SOUTH SIDE OF THE HIGHWAY, BUT ON THE NORTH SIDE THAT IT BE <br />REZONED AGRICULTURAL. <br />MR. BERG STATED THAT MR. ANSIN WHO OWNS PROPERTY ON THE <br />SOUTH SIDE MET WITH THE ZONING COMMISSION AND REQUESTED THAT HIS <br />PROPERTY BE LEFT COMMERCIAL AND THAT IT BE REFLECTED ON THE MASTER <br />PLAN. <br />49 <br />sooK 35 PA; -,r 153 <br />II <br />
