AFTER SOME DISCUSSION, THE BOARD AGREED TO RECESS FOR <br />LUNCH AND CONTINUE THE PUBLIC HEARING•AT 1:30 O'CLOCK P.M. <br />THE BOARD THEREUPON RECESSED AT 12:45 O'CLOCK P.M. FOR <br />LUNCH AND RECONVENED AT 2:00 O'CLOCK P.M. WITH THE SAME MEMBERS <br />PRESENT. <br />CHAIRMAN WODTKE ANNOUNCED THAT THE PUBLIC HEARING ON <br />THE TOURIST DEVELOPMENT TAX ORDINANCE WOULD CONTINUE AT THIS TIME. <br />COMMISSIONER SCHMUCKER NOTED THAT THIS ORDINANCE IS IN <br />ACCORDANCE WITH STATE LAW, AND THE INTERPRETATION OF WHETHER YOU <br />DQ OR DO NOT PAY THE TAX IS UP TO THE STATE. ALSO A TWO-YEAR <br />LIMITATION WOULD NOT BE INACCORDANCE WITH STATE LAW WHICH REQUIRES <br />THE TOURIST DEVELOPMENT COUNCIL MEMBERS TO BE APPOINTED FOR FOUR- <br />YEAR TERMS. HE POINTED OUT THAT THIS MUST BE PRESENTED TO THE <br />ELECTORATE AS THE PRESENT LAW DICTATES. <br />ON MOTION BY COMMISSIONER Loy, SECONDED BY COMMISSIONER <br />SCHMUCKER, THE BOARD UNANIMOUSLY CONTINUED THE PUBLIC HEARING ON <br />THE TOURIST DEVELOPMENT TAX ORDINANCE UNTIL THE NEXT REGULAR <br />COMMISSION MEETING OF AUGUST 9, 1978, AT 11:00 A.M. AND AGREED TO <br />ASK THE TOURIST TAX ADVISORY COUNCIL TO RECONSIDER THE POINTS THAT <br />HAVE BEEN BROUGHT UP TODAY AND, MORE SPECIFICALLY, TO J NVITE THE <br />CITY OF VERO BEACH AND ANYONE ELSE INVOLVED, TO CONSULT WITH THEM <br />ON.THE PROPOSALS MADE. <br />AL AIKEN APPEARED REPRESENTING FLORIDA LAND COMPANY <br />WHICH IS REQUESTING ABANDONMENT OF A PORTION OF PECAN GROVE ROAD <br />AS DISCUSSED AT AN EARLIER MEETING. <br />CHAIRMAN WODTKE ASKED IF THEY HAVE RECEIVED THE CONCURRENCE <br />OF THE DRAINAGE DISTRICT ON THE PROPOSED ABANDONMENT, <br />MR. AIKEN STATED THAT THEY MET WITH THE DRAINAGE DISTRICT <br />LAST WEEK, AT WHICH TIME THE DISTRICT PASSED A RESOLUTION CONCURRING <br />WITH THE ABANDONMENT, BUT IT COULDN'T BE COMPLETED BECAUSE THE <br />CHAIRMAN IS OUT OF TOWN. <br />COMMISSIONER LOY ASKED IF THE DRAINAGE DISTRICT IS <br />IMPOSING ANY CONDITIONS THAT WILL BE A PROBLEM, AND MR. AIKEN <br />STATED THAT THEY HAVE AGREED TO ESCROW DEEDS WITH THEIR ATTORNEY <br />JUL -1 91978 <br />54 <br />
