Federal Water Pollution Control Act, as Amended <br />M <br />The following sections of the Federal Water Pollution Control Act, <br />as amended, are pertinent to this Administrative Order: <br />Section 301(a) (33 U.S. C. 1311(a)): "Except as in compliance with <br />this section and sections 302,- 306, 307, 318, 402, and 404 of this Act, _ <br />the discharge of any pollutant by any person shall be unlawful. " <br />Section 402(a) (33 U.S. C.,,1342(a)): ". the Administrator may <br />. issue a permit for the discharge of any pollutant, or combinations <br />of polldiants, notwithstanding section 301(a) . . . . " <br />Section 402(k) (33 U.S. C. 1342(k)): "Compliance with a permit <br />issued pursuant to this section shall be'deemed compliance, for <br />purposes of sections 309 and 505, with sections 301, 302, 306, 307, <br />: and 403, except any standard imposed under section 307 for a toxic <br />pollutant injurious to human health . . . . " <br />Section 309(x)(3) (33 U. S. C. 1319(a)(3)): "Whenever on the basis <br />of any information available to him the Administrator finds that any <br />person is in violation of section 301, 302, 306, 307 or 308 of this <br />'Act, or is in violation of any permit condition or limitation imple- <br />menting any of such sections in a permit issued under section 402 <br />of this 'Act . . . , he shall issue an order requiring such person to <br />comply with such section or requirement, or he shall bring a civil <br />action in accordance with subsection (b) of this section. " <br />Section 309(d) (33 U.S. C. 1319(d)): -"Any person who violates <br />section 301, 302, 306, 307 or 308 of this Act, or any permit condition <br />or limitation implementing any of such sections in a permit issued <br />under section 402 of this Act . . . and any person who violates any <br />order issued by the Administrator under subsection (a) of this section, <br />shall be subject to a civil penalty not to exceed $10, 000 per day of <br />such violation.
