Pursuant to the above -referenced statutory authority which has been <br />delegated to me by the Administrator, I hereby make the following findings of* <br />facts <br />FINDINGS OF FACT <br />1.•• Ixora Utilities, Inc. (hereinafter, the Company), operates a <br />-facility in Vero Beach; Florida, which discharges pollutants into South Canal <br />:. to Indian River, a water of the United States. <br />2. Said facility has been issued and is subject to the provisions of <br />-National Pollutant Discharge Elimination System (NPDES) permit number FL0029858. <br />3. Part I, Section A of the subject permit sets out effluent limita- <br />tions,which are to be met by the said facility. (A copy of Section A is attached <br />to this Order and is incorporated herein by reference.) <br />4. Part I. Section C2 of the subject permit requires the Company to <br />1 . <br />.submit quarterly Discharge Monitoring Reports nd later than the 28th day of the <br />month following each completed.reporting period. <br />• 5. Discharge Monitoring Reports due on January 28, 1977, and April <br />A, 1977, covering the last three months of 1976 and the'first three months of <br />19779 respectively, have not been received by this office. <br />VIOLATIONS <br />• ~�•� �� 6.� ixora Utilities, Inc. -has violated the terms and conditions of <br />NPDI8 permit number FL0029858 in that the Company has failed to submit the required <br />Discharge Monitoring Reports. <br />ORDER <br />Based upon the foregoing; findings of fact and violations and pursuant to <br />the provisions of Section 309(x)(3) and (4) of the Federal Water Pollution Control <br />a <br />Act, as amended (33 U.S.C. 1319(a)(3) and (4)), it is hereby ordered: <br />�sr°�h p3i 398 <br />JUL 19197 <br />
