<br /> <br /> <br /> <br /> <br />conditions: (1) that the developer provide the items <br />listed in Item 20 “Trade-offs” in staff’s Memorandum <br />of October 11, 2004; (2) that prior to issuance of a land <br />development permit, the developer shall: (a) enter into a <br />developer’s agreement for off-site traffic improvements <br />as listed in items 11 and 15 of staff’s memorandum, (b) <br />obtain planning staff approval of all entry feature walls <br />and subdivision signs, (c) obtain release of 35’ of <br />th <br />Murphy Deed right-of-way along the site’s 27 Avenue <br />frontage, (d) obtain County and jurisdictional agency <br />permits for proposed wetland impacts, and (e) commit <br />to accepting into the project stormwater management <br />thstth <br />system run-off from 27 Avenue, 21 Street SW, 35 <br />rd <br />Avenue SW, and 23 Street SW; (3) that prior to final <br />plat approval for Phase 1, the applicant shall dedicate <br />the 18-acre school site and mitigate the site for wetland <br />impacts, bring the site up to grade, seed the site, and <br />provide sanitary sewer and water service to the site or <br />post security for such required improvements; (4) that <br />prior to or via the appropriate final plat(s), the developer <br />shall dedicate stormwater management rights and <br />thstth <br />right-of-way for 27 Avenue, 21 Street SW, 35 <br />rd <br />Avenue SW and 23 Street SW as described in staff’s <br />memorandum; and (5) that prior to issuance of a <br />certificate of completion for any phase, the required <br />improvements for that phase shall be completed, <br />including the items listed in item 10 “Phasing Plan” of <br />staff’s memorandum; all as recommended by staff. <br />OCTOBER 19, 2004 24 <br /> <br />
