He felt the agreement seemed too “open ended” and did not understand why they are <br />being asked to sign such an agreement. <br />County Administrator Joe Baird stated that this is a standard form and all private <br />subdivisions are being asked to sign. To date, all subdivisions have signed without question. He <br />believed that Mr. Ferretti wants the ability to sue the County if something should go wrong. The <br />County is not required to do this and is simply wanting to be held harmless from any damages. He <br />advised Mr. Hall that they are certainly free to hire someone else to pick up the debris and stated <br />that the County has done an excellent job in over 70 private subdivisions to date. He could not <br />offer a guarantee as to when the debris could be picked up and pointed out that FEMA will not <br />reimburse the County for debris removal in private subdivisions, so these costs are entirely being <br />paid by the taxpayers. FEMA reimburses 90% of the cost of debris removal on public roads, but <br />nothing on private ones. <br /> County Attorney Will Collins noted that this is the same “hold harmless” agreement that <br />the Army Corps of Engineers has signed when they go on someone’s property to repair or tarp a <br />roof. <br /> NO ACTION REQUIRED OR TAKEN. <br /> <br />9.B.4.
