Request to Speak from Mark A. Brackett Regarding 30 Day Extension to <br />the Construction Contract for the Stoney Brook Farm Subdivision <br /> <br />th <br />Mark Brackett, <br />1915 34 Avenue,on behalf of Stoney Brook Farms Subdivision, recounted the <br />process from Stoney Brook’s recordation of a plat which at that time required them to enter into a <br />construction agreement with the County and to provide surety to secure the completion of the <br />improvements that were tied to the contract and the subsequent grant of a 60-day extension which expires <br />on October 12, 2006. He said they were near completion of the subdivision and have final release of liens <br />from both utilities and site contractors, but in order to be in compliance with the code and to not leave a <br />gap between completing the project officially and having the appropriate surety in place, they were <br />asking the County to grant them a 30-day extension on the construction contract and the Surety would be <br />extended additionally for the Stoney Brook Farm Subdivision. If they get the extension, they would have <br />$900,000.00 in Surety for punch list items. <br /> <br />County Attorney William Collins provided further background on staff’s prior recommendation <br />for a 60-day extension instead of the one-year extension requested by Mr. Brackett, citing staff’s lack of <br />confidence with the company because of past experience with them not honoring conditions to have <br />security in place until a specified date. <br /> <br />October 3, 2006 <br />46 <br /> <br />
