<br />Chairman Neuberger sought to know what the Board thought of this. Commissioner Davis had <br />no problem with the request but wanted to hear comments from any homebuilder present. <br /> <br />Administrator Baird and Attorney Collins discussed the Letter of Credit, noting that it is about to <br />expire on October 12, 2006, and were not sure the bank would be willing to extend the Letter of Credit. <br /> <br />Mr. Brackett <br />said hehad no knowledge that the bank would not extend the Letter of Credit. <br />Assistant County Attorney Bill DeBraal reminded the Board that there was an issue of turn lanes <br />that needed to be addressed that is part of the security that has been posted, and he did not know how far <br />Mr. Brackett had gotten towards the completion of that project. <br /> <br />Mr. Brackett <br />responded that the turn lane is not a condition of the Certificate of Completion and <br />that there is property security up for the turn lane and would remain in place. <br /> <br />Public Works Director Jim Davis clarified the conditions for turn lanes. <br /> <br />MOTION WAS MADE BY Commissioner Davis, SECONDED <br />by Commissioner Neuberger, to grant the 30-day extension on <br />condition that the letter of credit be extended as well. <br /> <br />Administrator Baird cautioned that the Letter of Credit (LOC) has to be extended for more than <br />thirty (30) days because the turn lanes could not be done in thirty (30) days. <br /> <br />Mr. Brackett <br /> was looking for a 30-day extension on the construction agreement and would <br />accept 180 days on the LOC. <br /> <br />Commissioner Bowden felt they needed to have a working relationship where information from <br />staff is forthcoming prior to when decisions have to be made. <br /> <br />October 3, 2006 <br />47 <br /> <br />
