COUNTY ATTORNEY MATTERS -BLACK BEAR RESERVE - <br />45TH STREET BETWEEN KINGS HIGHWAY AND 66TH AVENUE <br />- REQUEST TO CALL BOND - TIM ROSE CONSTRUCTION - <br />BRACKETT & COMPANY <br />Assistant County Attorney Bill DeBraal reviewed his memorandum defining a problem for <br />homeowners in Black Bear Reserve being unable to occupy their homes because the developer has <br />not completed the required improvements. The County will not issue certificates of occupancy <br />until the subdivision is completed. The developer has been on notice since July 2005 of the <br />problems associated with this development. Due to the lack of progress to address these problems, <br />the County's sole remedy is to call the bond that was provided for this project. <br />Jeff Blackstone, Brackett and Company, commented out of the three areas of concern two <br />have been resolved and only the largest issue at this point is relating to the roads. They are <br />working with County staff He asked that the Board take no action and give them 30 days to finish <br />off the subdivision. <br />County Attorney Collins stated it has been 3 months since they were contacted (July 2005) <br />and they have not seen any progress. <br />MOTION WAS MADE by Commissioner Wheeler, <br />SECONDED by Commissioner Neuberger, to table this <br />item for 30 days. <br />Commissioner Davis wanted to have the motion include calling the bond if the subdivision <br />is not done in 30 days to avoid the item having to come back to the Board. <br />October 4, 2005 41 <br />
