CONSIDERATION OF THE STATUS OF WATERWAY VILLAGE'S <br />(DIVOSTA) PRIOR VESTED UNITS <br />Director Boling informed the Board that since the meeting of December 5, 2006, <br />staff had not vested any additional Waterway Village units, and had continued to keep the 733 <br />previously vested units in the concurrency management system. He said that staff requested the <br />Board to either confirm staff's decision to continue to vest the units or direct staff to make <br />appropriate changes. Director Boling gave a PowerPoint presentation (copy on file) which <br />summarized vesting for Waterway Village. He stated that staff recommended there be no changes <br />to the vesting of the 733 units at this time. <br />Attorney John Shubin, from Shubin and Bass, Special Counsel to the County, <br />agreed with staff, that 234 units must be vested and all impact fees must be paid, however, he did <br />not think the 733 -units required vesting. <br />MOTION was made by Vice Chair Bowden, SECONDED <br />by Commissioner Davis, to table this item to allow <br />Attorney Shubin and staff to work out the problems and <br />provide a recommendation to the Board. <br />There was a brief discussion regarding the units already vested. <br />January 23, 2007 25 <br />
