b <br />ATTORNEY COLLINS INFORMED THE BOARD THAT THERE ARE A NUMBER <br />OF GRAY AREAS IN REGARD TO IMPLEMENTATION OF THE FLOOD ORDINANCE, AND <br />THE PLANNING DEPARTMENT HAS RECOMMENDED THAT WE TRY TO SOLVE SOME OF <br />THESE ON A LOCAL LEVEL BY ADDING A VARIANCE SECTION TO TiE ORDINANCE. <br />4 <br />THE ATTORNEY FELT THE VARIANCE BOARD COULD HANDLE SUCH MATTERS AND <br />STATED THAT SUCH A SECTION WAS NOT ORIGINALLY INCLUDED AS THEY WERE <br />TRYING TO KEEP THE ORDINANCE AS BRIEF AS POSSIBLE. SIE CONTINUED THAT <br />HE FEELS THERE IS A NEED FOR THIS AND HE WOULD LIKE AUTHORIZATION TO <br />ADVERTISE. <br />COMMISSIONER SIEBERT INQUIRED IF SUCH A SECTION 111ILL BE <br />ACCEPTABLE AT THE FEDERAL LEVEL, <br />ATTORNEY COLLINS STATED THAT HE HAS A FORM ORDINANCE WHICH <br />WAS SUBMITTED TO US AS SOMETHING VIE SHOULD ADOPT VIITiOUT CHANGES, AND <br />HE WILL DRAW UP THE VARIANCE SECTION TO BE CONSISTENT WITHIN THAT <br />FORM.. <br />COMMISSIONER SIEBERT STATED THAT HE WOULD LIKE TO BE SURE <br />SUCH A SECTION IS ACCEPTABLE BEFORE IT IS OFFICIALLY ADOPTED, <br />ON MOTION BY COMMISSIONER SCHMUCKER, SECONDED BY COMMISSIONER <br />SIEBERT, THE BOARD UNANIMOUSLY AUTHORIZED THE ATTORNEY TO ADVERTISE <br />AN AMENDMENT TO THE FLOOD ORDINANCE TO PROVIDE FOR A VARIANCE SECTION. <br />IN REGARD TO AN AMENDMENT TO THE MINING ORDINANCE, ATTORNEY <br />COLLINS INFORMED THE BOARD THAT THE PLANNING DIRECTOR HAS REQUESTED <br />THAT THE BOARD NOT TAKE ANY ACTION ON THIS AND LET IT GO THROUGH THE <br />PLANNING & ZONING COMMISSION AND COME BACK THROUGH THE REGULAR CHANNELS, <br />THE HOUR OF 9:30 O'CLOCK A.M.
