There was a lengthy question and answer period between the Board and staff to learn more <br />regarding vesting, issuance of concurrency certificates, the comprehensive plan with possible <br />changes, and the comprehensive concurrency analysis process. <br />Director Keating explained that if a three-year certificate expired, the capacity assigned <br />would become available again; and if that same project would come back, they would have to "get <br />back in line" but at that point capacity might not be available. He also noted that the clock would <br />start when the fees were paid. Director Keating clarified that at site plan release his staff would <br />ensure all conditions have been met and all jurisdictional agency permits have been obtained <br />before building permit. <br />Director Boling informed the Board that staff was going to allow a seven year concurrency <br />vesting for developers who would enter into agreements to produce road and capacity producing <br />projects. <br />Vice Chair Bowden wanted to know what the parameters were for schools. <br />Director Keating explained that staff looked at the schools that were in the first three years <br />of the five-year work program as being able to count capacity. He noted that if schools were in the <br />five-year work program (even in the forth and fifth year) a developer could do a proportionate <br />share mitigation application and then count that capacity. <br />Director Boling detailed the outcome of the two Committees then asked the Board to make <br />a policy decision. <br />There was a lengthy question and answer period between the Board and staff regarding <br />rationing trips and pulling building permits. <br />January 5, 2007 3 <br />CHAPTER 910 <br />
