PUBLIC HEARING – ORDINANCE NO. 2004-034 – LLONALD <br />AND VICKIE MIXELL’S REQUEST TO REZONE 36.5 ACRES <br />FROM A-2 TO RS-3 <br />PROOF OF PUBLICATION OF ADVERTISEMENT FOR HEARING IS ON FILE IN THE <br />OFFICE OF THE CLERK TO THE BOARD <br /> <br />Community Development Director Bob Keating reviewed the matter using a <br />PowerPoint presentation and incorporated his presentation from the October 12, 2004 meeting <br />when the Board tabled the matter for further information. He explained that either RS-2 or RS-3 <br />zoning would complicate what the applicant wanted to do and either was consistent with the <br />Comprehensive Plan. He discussed this with Mr. Mixell a day earlier. The Board consider <br />adopting RS-2 in order to reduce the number of lots allowed on the parcel. <br />In response to Vice Chairman Neuberger, Director Keating elaborated on the <br />differences between RS-3 and RS-2 stressing that either zoning would accommodate Mr. Mixell’s <br />intention. <br /> <br />The Chairman opened the public hearing and asked if anyone wished to be heard <br />regarding this matter. <br /> <br />Llonald Mixell, <br />owner of the property, explained that he had leased the house on <br />the corner of his property, had told the tenant he was willing to sell the house, and knew he would <br />have to make some kind of zoning change to do that. He related his efforts to accomplish this sale <br />and how he attempted to rezone just the one lot because he wanted to retain the agricultural zoning <br />for the rest of the property. He gave assurances that he had no intention of developing the rest of <br />the 36.5-acre parcel. His quest had thus far cost him $7,000 and while he understood that either the <br />RS-2 or RS-3 would give him the ability to break out that lot, he objected now to RS-2 zoning on <br />November 2, 2004 <br />13 <br /> <br />
