Mr. Schafer agreed to wait another week for the letter. <br />Since his brother owns a sand mine, Chairman Davis announced he would abstain from <br />voting and requested that Vice Chairman Flescher execute the subject document after its <br />approval. <br />MOTION WAS MADE by Commissioner O'Bryan, <br />SECONDED by Vice Chairman Flescher, for the County <br />Attorney to bring to the November 10, 2009 Board of <br />County Commission meeting for Board approval, a <br />"Letter of Intent" to enter into a contract with Ranger <br />Construction Industries, Inc., to be executed by the Vice <br />Chairman, for the Sector 3 Beach Renourishment Project, <br />within five (5) days after final permit issuance by the <br />Florida Department of Environmental Protection (FDEP). <br />Commissioner Solari was concerned that the FDEP might issue the permit with less <br />quantities of sand than was specified in the County's application. This sparked further <br />discussion on whether the Letter of Intent should include permit approval authorizing a specific <br />amount of sand. <br />Dr. Gorham advised that the FDEP would either approve or deny the permit as per the <br />modified application which was submitted, but they could not issue the permit for less sand; if <br />they stipulated less sand, it would have to be with the consent of the applicant. <br />The Chairman CALLED THE QUESTION, and by a 4-0 <br />vote (Chairman Davis recused himself), the Motion <br />carried.
