He conveyed that the draft Biological Opinion from the U.S. Fish and <br />Wildlife Service was received on November 25, 2009, and that his staff's comments had been <br />sent directly back to the Service. Dr. Gorham stressed the importance of the Biological Opinion <br />for the Federal and State permitting. He conveyed that staff was seeking a commitment from the <br />Service as to when they could expect the Biological Opinion to be signed by the director. He <br />disclosed that Michael Walther, President of Coastal Technology Corporation, Inc., had <br />scheduled a meeting with DEP staff for December 3, 2009, to seek a commitment for the <br />issuance of the draft permit. <br />Dr. Gorham acknowledged that he was preparing a webpage for the County's website <br />that would provide updates on the progress of the project, as well as a forum for answering <br />questions. <br />12..1 UTILITIES SERVICES - NONE <br />13. COUNTY ATTORNEY MATTERS <br />13.A. REALIGNMENT OF 101STAVENUE/102ND TERRACE <br />Deputy County Attorney Bill DeBraal reviewed his Memorandum of November 5, 2009, <br />recalling the details involved with the first phase of the recent property exchange with the Board <br />of Trustees of the Internal Improvement Fund of the State of Florida, and outlined the Exchange <br />Agreement of the second phase. He highlighted the four proposed options on page 262 of the <br />backup, and recommended the Board direct staff to proceed accordingly. <br />A lengthy discussion ensued among the Board pertaining to the different options, the <br />traffic on 102nd Terrace and whether to add a second traffic signal, requirements of the Exchange <br />Agreement, and setting aside funds for the restoration of 102nd Avenue. <br />29 <br />December 1, 2009 <br />
