AT THAT POINT FROM AN EXISTING BORROW PIT. MR. LUETHJE STATED THAT WHEN <br />THE NEXT PHASE IS DEVELOPED, THEY PLAN TO FILE ANOTHER UTILITY AND <br />DRAINAGE EASEMENT PLAT WHICH WILL PROBABLY COVER THE ENTIRE SUBDIVISION. <br />HE CONTINUED THAT MR. MAGUIRE ACTUALLY HAS PURCHASED ALL OF THE LAND, <br />BUT MRS. WALKER, WHO HAS HER HOME THERE, WILL BE ALLOWED TO STAY UNTIL <br />IT IS DEVELOPED. MR. LUETHJE NOTED THAT THE ROADS ARE DEDICATED AND <br />WILL BE CURBED AND GUTTERED. THEY ARE CULVERTING THE DRAINAGE ON THE <br />REAR LOT LINE. <br />ATTORNEY COLLINS ASKED WHAT THE REASON WAS FOR NOT REPLATT_ING, <br />AND MR. LUETHJE EXPLAINED THAT IF THEY DID, THEY WOULD HAVE TO GO TO <br />1/2 ACRE LOTS, BUT NOW THEY ARE GRANDFATHERED IN. BY FILING ANOTHER PLAT, <br />THEY ARE JUST ADDING THE SERVICES TO IT, WHICH DOES NOT CHANGE ANYTHING. <br />ATTORNEY COLLINS FELT THE BOARD SHOULD MAKE SOME AGREEMENT <br />WITH THE DEVELOPER FOR THE ROADS TO BE PUT IN ACCORDING TO SUBDIVISION <br />REQUIREMENTS. <br />ADMINISTRATOR JENNINGS EXPLAINED THAT THIS HAS BEEN DISCUSSED <br />AND IS TO BE DONE, BUT AN AGREEMENT WOULD BE FINE. $INCE THIS IS AN OLD <br />PLATTED SUBDIVISION, NO DRAINAGE WAS SHOWN, AND THEY ARE JUST PLANNING <br />TO UPGRADE THE OLD SUBDIVISION, USING THE SAME LAYOUT. <br />MR. LUETHJE COMMENTED THAT THE ROADS HAVE BEEN DESIGNED TO j <br />COUNTY SPECIFICATIONS AND THERE IS A CONTRACT ON THEM, HE STATED THEY <br />WOULD LIKE TO FINALIZE THIS AS SOON AS POSSIBLE. <br />ADMINISTRATOR .JENNINGS RECOMMENDED THAT THE ROADS BE BUILT <br />' JUST AS THEY HAVE THEM DESIGNED, BUT EXPRESSED CONCERN ABOUT THE COUNTY <br />HAVING ASSURANCE THAT THE ROADS WILL BE PAVED ACCORDING TO COUNTY REQUIRE- <br />MENTS BEFORE THEY PROCEED TO SELL THE LOTS, HE'SUGGESTED FILING A <br />PERFORMANCE BOND. <br />MR. LUETHJE STATED HE COULD NOT ANSWER WHETHER HIS CLIENT WOULD <br />FURNISH A BOND, AND NOTED THAT HIS CLIENT'S ATTORNEY STATED THAT LEGALLY <br />.�� THE LOTS COULD BE SOLD RIGHT NOW AS THIS IS A RECORDED SUBDIVISION. <br />ADMINISTRATOR JENNINGS AGREED THEY COULD, BUT FELT ANYBODY <br />BUYING THESE LOTS WOULD HAVE TROUBLE GETTING A BUILDING PERMIT.
