The Chairman asked if anyone else wished to be heard regarding this matter. There being <br />none, the Chairman closed the public hearing. <br />ON MOTION by Commissioner Lowther, SECONDED by <br />Commissioner Adams, the Board by a 4-1, Commissioner <br />Ginn opposed, found that in conjunction with the <br />recommended conditions it is empowered under the <br />provisions of Chapter 971 to review the special exception use <br />applied for; the granting of the special exception use will not <br />adversely affect the public interest; and the application <br />satisfied the general and specific criteria required for special <br />exception approval; and granted special exception use <br />approval for the country club use with the following <br />conditions: <br />1. Prior to issuance of a certificate of occupancy for the <br />project, the applicant shall: <br />a. Construct a southbound right -turn lane on Indian <br />River Boulevard at the project entrance; <br />b. Construct or bond -out the required Indian River <br />Boulevard sidewalk; and <br />C. Construct all required landscape buffers <br />2. After issuance of a C.O., the applicant must make any <br />necessary adjustments to site lighting to ensure <br />compliance with the light shielding buffers, all as <br />recommended by staff in their memorandum dated <br />December 9, 2003. <br />DECEMBER 16, 2003 28 <br />
