Attorney Collins noted that there must be a public hearing before any franchise <br />could be awarded and that would be the proper time for the requested discussion. He stated <br />that for any individual potential applicant to speak now would be fraught with peril for <br />everyone. <br />Vice Chairman Flescher stated that he had not known what Mr. Westover or his <br />attorney was going to bring forward, but he had wanted to at least request the opportunity for <br />Mr. Westover to speak. <br />Attorney Collins stated that the Board would have to approve this matter <br />unanimously. <br />Matt Moral, 2850 North Andrews Avenue, Ft. Lauderdale, FL, legal counsel <br />for Mr. Westover, and representing Republic Services Limited of Florida, LP, dba Treasure <br />Coast Refuse, sought and was denied permission (pursuant to legal requirements), to discuss <br />the existing franchise held by Treasure Coast Refuse. <br />MOTION WAS MADE by Commissioner Wheeler <br />to not add Item 10.B. Public Discussion Items, to <br />the Agenda, and to bring it back at the appropriate <br />time. <br />Chairman Davis explained that the policy for emergency additions was that one <br />individual Board member could prohibit an emergency item from being added to the Agenda. <br />ON MOTION by Commissioner O'Bryan, <br />SECONDED by Commissioner Solari, by a 4-1 vote <br />3 <br />December 16, 2008 <br />
