PUBLIC HEARING - ORDINANCE NO. 2003-037 <br />REZONING APPROXIMATELY 22.08 ACRES FROM A-1 TO RS -3 AS <br />REQUESTED BY SARTOR LLC - SOUTH SIDE OF 12TH STREET <br />EAST OF 54TH AVENUE (Quasi -Judicial) <br />PROOF OF PUBLICATION OF ADVERTISEMENT FOR HEARING <br />IS ON FILE IN THE OFFICE OF THE CLERK TO THE BOARD <br />Community Development Director Robert Keating made a Power Point presentation <br />showing the site and zoning of its surrounding properties. (Filed with the backup in the <br />office of the Clerk to the Board.) He also covered the rest of the main points of the <br />memorandum dated October 13, 2003 advising of the conclusion and recommendation of <br />staff to approve the request and adopt the proposed ordinance. <br />The Chairman opened the public hearing and asked if anyone wished to be heard in <br />this matter. <br />Brian Heady, Vero Beach, was opposed to increasing density and zoning. He <br />suggested putting a moratorium on zoning changes and urged them to stop the growth. He <br />believed that property values will go up if they do. <br />Chairman Macht agreed with some of Mr. Heady=s points, but asked County <br />Attorney Collins to explain about individual property rights. <br />County Attorney Collins explained that this county set up the Land Development <br />Regulations and the Comprehensive Plan. Someone has the right to make an application if <br />their request is consistent with the plans. He was not sure property values would go up if <br />we keep things as they are. If the goal is exclusivity; we may be affecting a taking of their <br />December 2, 2003 <br />12 <br />
