PRIVATE PROPERTIES. <br />HE DISCUSSED EMINENT DOMAIN, WHICH PROVIDES FOR JUST <br />COMPENSATION TO AN OWNER FOR THE USE OF HIS PRIVATE PROPERTY FOR THE <br />RIGHT—OF—WAY, INCLUDING DAMAGES OCCURRED ON HIS PROPERTY OR ANY SEVERANCES. <br />COMMISSIONER SIEBERT, WHO IS A MEMBER OF THE TREASURE COAST <br />REGIONAL PLANNING COUNCIL, ASKED IF THE BOARD IS SUPPOSED TO APPROACH <br />THE LOCAL REVIEW OF THE DRI FROM A REGIONAL STANDPOINT OR STRICTLY FROM <br />A COUNTY STANDPOINT. <br />PIR. FAIR FELT IT WOULD BE FROM A REGIONAL STANDPOINT, SINCE <br />LOCAL REVIEW IS SUPPOSED TO BE BASED ON THE REGIONAL FINDINGS AND REC— <br />OMMENDATIONS. HE CONTINUED THAT OBVIOUSLY, THEY ARE HERE BEFORE THE <br />BOARD SEEKING THEIR APPROVAL AS THERE IS BOUND TO BE LOCAL CONCERN. <br />COMMISSIONER SIEBERT ASKED WHAT TOOK PLACE AT THE MEETING IN <br />ST: LUCIE COUNTY YESTERDAY. <br />MR, FAIR COMMENTED THAT THERE IS AN EXTENSIVE AMOUNT OF GROVE <br />AREAS IN THAT COUNTY,AND GROVE OPERATORS AND OWNERS WERE CONCERNED THAT <br />THIS TRANSMISSION PROJECT WOULD INTERFERE WITH AERIAL SPRAYING, AND THIS <br />QUESTION WAS NOT RESOLVED AT THE HEARING.e HE CONTINUED THAT THE ISSUE <br />WAS NOT THAT THE TRANSMISSION LINES WERE THERE BUT WHERE THEY WERE <br />LOCATED WITH RESPECT TO THE GROVES AND THEY ARE GOING TO WORK OUT SOME <br />SORT OF A COMPROMISE SOLUTION,�TO THAT PROBLEM. HE EXPLAINED THAT THEY <br />SPAN OVER THE TOP OF THE TREES AND LEAVE THEM IN THE RIGHT—OF—WAY, EXCEPT <br />FOR A FEW AROUND THE STRUCTURES; THEY SEE THE GROVES AS VERY COMPATIBLE <br />' MULTIPLE USE OF THE RIGHT—OF—WAY AND VERY BENEFICIAL. <br />MR. FAIR THEN DISPLAYED A MAP FROM THE WATER MANAGEMENT DISTRICT <br />WHICH SHOWS A SOUTHWARD EXTENSION OF THE CONSERVATION AREA THEY NOW OWN <br />AND THEY ARE NOW ACQUIRING PROPERTY THERE WITH A VIEW TOWARD FLOODING AT <br />VARIOUS TIMES OF THE YEAR FOR WATER MANAGEMENT PURPOSES. HE CONTINUED <br />THAT THEY WILL FLOOD IT UP TO A-30' CONTOUR LINE AND THE MANAGEMENT <br />`L DISTRICT FELT IT WAS NOT FEASIBLE FOR FLORIDA POWER & LIGHT TO LOCATE A <br />TRANSMISSION LINE WITHIN THAT FLOODING AREA. MR. FAIR STATED THAT THEY <br />HAVE GONE AROUND THIS CONSERVATION AREA AND HAVE AMENDED THEIR APPLICATION <br />TO REFLECT THAT CHANGE; AFTER IT HAD BEEN SUBMITTED TO•LOCAL GOVERNMENTS <br />AND THE REGIONAL PLANNING COUNCIL. <br />27 <br />FEB 2 1 1979 <br />BOOK 39 PAGE 108 <br />I <br />
