f <br />SOCIETY AND THE WATER MANAGEMENT DISTRICT TO OBTAIN INFORMATION <br />REGARDING THE KIND OF SERVICES AVAILABLE TO PROTECT THE COUNTY'S WATER <br />SUPPLY, <br />DISCUSSION ENSUED REGARDING THE VARIOUS WATER STUDIES; <br />THE CHAIRMAN CALLED FOR THE QUESTION, IT WAS VOTED ON AND <br />CARRIED UNANIMOUSLY, <br />ATTORNEY COLLINS NEXT BROUGHT UP THE SUBJECT OF RETIREMENT <br />BENEFITS AND ASKED THAT IT BE DEFERRED UNTIL THE NEXT MEETING, HE THEN <br />REPORTED THAT AT THE PRE -CONSTRUCTION MEETING HELD ON MARCH 6, 1979 ON <br />PHASE Z OF THE GIFFORD WATER PROGRAM, THE QUESTION AROSE AS TO WHETHER OR <br />NOT THE CHAIRMAN HAS BEEN AUTHORIZED TO SIGN ALL DOCUMENTS PERTAINING <br />TO THIS PROJECT, <br />DISCUSSION FOLLOWED ALONG THOSE LINES. <br />ON MOTION BY COMMISSIONER LYONS, SECONDED BY COMMISSIONER Loy, <br />THE BOARD UNANIMOUSLY AUTHORIZED THE CHAIRMAN TO SIGN ANY AND ALL <br />DOCUMENTS THAT RELATE TO THE IMPLEMENTATION OF THE PHASE Z GIFFORD WATER <br />PROGRAM AND TO FURTHER AUTHORIZE THE COUNTY ADMINISTRATOR TO EXECUTE <br />A NOTICE TO PROCEED, <br />ATTORNEY COLLINS NEXT DISCUSSED THE LAWSUIT ENTITLED INDIAN <br />RIVER COUNTY VS. GOODKNIGHT AND BAGALEY, <br />ON MOTION BY COMMISSIONER LYONS, SECONDED BY COMMISSIONER Loy, <br />THE BOARD UNANIMOUSLY APPROVED AND RATIFIED THE COUNTY ATTORNEY'S ACTION <br />IN FILING INJUNCTION PROCEEDINGS IN THE LAWSUIT ENTITLED INDIAN RIVER <br />COUNTY VS. GOODKNIGHT AND BAGALEY. <br />ATTORNEY COLLINS BROUGHT UP THE SUBJECT OF THE COURTS DISMISSING <br />ATTORNEY CLEM'S COMPLAINT ON ONE ACRE SUBDIVISIONS. HE CONTINUED THAT <br />HE WOULD LIKE TO WRITE TO EACH OF THE SUBDIVISIONS THAT HAVE ONE ACRE OR <br />MORE TELLING THEM THAT THIS PROBLEM EXISTS OF DIVIDING THE ONE ACRE LOTS <br />AND/OR BUILDING MORE THAN ONE HOUSE ON THEM, AND THEY SHOULD COME TO THE <br />COUNTY FOR REZONING TO RIE. <br />COMMISSIONER Loy SUGGESTED CHECKING THE DEED RESTRICTIONS IN <br />ORDER NOT TO UPSET ANY OF THE PROPERTY OWNERS, <br />ATTORNEY COLLINS CONTINUED THAT HE IS CONCERNED THAT THE <br />ORDINANCE PERTAINING TO THIS PROBLEM WAS PASSED ON AN EMERGENCY BASIS <br />AND FELT IT WAS NOT A GOOD ORDINANCE TO HAVE ON OUR BOOKS. <br />46 <br />9 FAGE7 <br />
