MR.-FLYNN EXPLAINED THAT IT IS EASIER TO NEGOTIATE FOR YOUR <br />DOLLAR VALUE UP TO ABOUT $2,500 AND POINTED OUT THAT THIS IS NOT.FIRM <br />BECAUSE THE ADMINISTRATOR CAN INSTRUCT HIM TO BID ON ANYTHING. THIS <br />JUST PROVIDES SOME LATITUDE. <br />CHAIRMAN WODTKE THEN QUESTIONED THE WORDING "UNIT VALUE" AND <br />ASKED HOW THIS WOULD APPLY TO $10,000 WORTH OF PAPER. <br />MR. FLYNN STATED THAT UNIT VALUE IS USUALLY A "ONE BUY" - THE <br />COST PER BUY. <br />AFTER -FURTHER DISCUSSION, IT WAS AGREED TO REWORD THE SECOND <br />PARAGRAPH UNDER 2A ON PAGE 4 AS FOLLOWS: "PURCHASES WITH A VALUE OF <br />$2,500 OR MORE WILL BE LET FOR BIDDING. THIS DOES NOT ELIMINATE THE <br />POSSIBILITY OF BIDDING ITEMS WITH A LOWER VALUE THAN $2,500 SHOULD THE <br />COUNTY ADMINISTRATOR FEEL THAT IT WOULD BE IN THE BEST INTEREST OF THE <br />COUNTY TO DO SO." <br />COMMISSIONER SIEBERT REVIEWED PAGE 5 AND NOTED THAT SPECIFICA- <br />TIONS CAN BE WRITTEN SO THAT THEY EXCLUDE ALL BUT ONE BIDDER. HE FELT <br />IT SHOULD BE STATED SPECIFICALLY THAT SPECIFICATIONS SHALL NOT BE WRITTEN <br />TO EXCLUDE PRODUCTS OR EQUAL OR COMPARABLE QUALITY. <br />MR. FLYNN POINTED OUT THAT IT SAYS "SPECIFICATIONS ... MAY BE <br />MODIFIED TO PERMIT COMPETITIVE"BIDDING AND TO PROVIDE FOR A LEVEL OF <br />QUALITY COMMENSURATE WITH THE INTENDED USE OF THE ARTICLE." <br />COMMISSIONER SIEBERT NOTED THAT THIS SAYS "MY BE" SO YOU <br />COULD STILL SEND OUT SPECIFICATIONS THAT WOULD ELIMINATE EVERYONE EXCEPT <br />ONE BIDDER. <br />IT WAS AGREED TO ADD THE FOLLOWING TO SECTION (B) ON PAGE 5: <br />"SPECIFICATIONS WILL NEVER BE WRITTEN IN SUCH A WAY THAT ONLY ONE SOURCE <br />OR VENDOR WOULD QUALIFY.". <br />COMMISSIONER SIEBERT ASKED IF A BID BOND IS THE SAME AS A <br />PERFORMANCE BOND, AND MR. FLYNN STATED THAT IT IS NOT, HE COMMENTED THAT <br />THE BOARD RESERVES THE RIGHT TO REQUIRE A PERFORMANCE BOND. <br />COMMISSIONER SIEBERT ASKED ABOUT THE PURPOSE OF A BID BOND, AND <br />MR. FLYNN EXPLAINED THAT A BID BOND IS NORMALLY REQUIRED FOR LARGE JOBS <br />TO QUALIFY THAT A BIDDER IS FINANCIALLY STABLE.
