ATTORNEY POINTED OUT THAT IF A DEVELOPER WERE TO GO THE PARTY WALL <br />SYSTEM, HE'WOULD STILL HAVE TO COME BEFORE THE SUBDIVISION REVIEW COM- <br />MITTEE, FILE A SITE PLAN, AND HAVE THE SAME DENSITY REQUIREMENTS, ETC., <br />AS ANY OTHER UNITS. ATTORNEY COLLINS CONTINUED THAT HE DOES'•NOT SEE <br />THAT OUR ORDINANCE -MAKES ANY DISTINCTION AS TO WHO OWNS THE LAND UNDER <br />THE UNIT. <br />COMMISSIONER SIEBERT ASKED IF THIS COULD BE CONSIDERED A <br />MULTI -FAMILY UNIT, AND THE ATTORNEY NOTED THAT THERE ARE FOUR UNITS IN <br />ONE BUILDING AND THAT IS A MULTI -FAMILY UNIT. COMMISSIONER SIEBERT <br />ASKED IF THEY COULD MEET THE CRITERIA FOR A SINGLE FAMILY UNIT UNDER <br />THE COMMON WALL CONCEPT, AND THE ATTORNEY DID NOT FEEL THAT WOULD BE <br />SINGLE FAMILY. <br />CHAIRMAN WODTKE DISCUSSED SINGLE FAMILY ATTACHED DWELLINGS, <br />AND ATTORNEY'COLLINS NOTED THAT WE HAVE TWO DEFINITIONS: "A SINGLE <br />FAMILY DWELLING IS THAT DESIGNED EXCLUSIVELY FOR ONE FAMILY AS A HOUSF- <br />KEEPING UNIT," AND MULTI -FAMILY IS `1A BUILDING DESIGNED FOR TWO OR MORE <br />FAMILIES INDEPENDENTLY OF EACH OTHER.", THE ATTORNEY CONTINUED THAT FROM <br />A SALES POINT OF VIEW IT'MAY BE WELL TO REPRESENT THESE UNITS AS SINGLE <br />FAMILY UNITS, BUT FROM A LEGAL STANDPOINT, HE BELIEVED THEY WOULD BE <br />MULTIFAMILY BECAUSE MORE TVAN ONE FAMILY LIVES IN THE BUILDING. HE <br />DID NOT SEE ANY DIFFERENCE AS TO WHETHER A DEVELOPMENT WAS DONE ON THE <br />CONDOMINIUM CONCEPT OR PARTY WALL CONCEPT. THE ATTORNEY STATED THAT THE <br />ADVANTAGE OF A PARTY WALL CONCEPT IS THAT YOU DON T HAVE TO BECOME <br />INVOLVED IN THE STRICT GOVERNMENT REGULATION OF CONDOMINIUMS. <br />ARCHITECT JOHN CALMES INFORMED THE BOARD THAT THERE HAS BEEN <br />A TREND OVER THE LAST FEW YEARS TO GET AWAY FROM CONDOMINIUMS, BUT IN <br />THIS AREA WE HAVE NO ORDINANCE TO ALLOW TOWN HOUSES OR "ZERO LOT LINE" j <br />DWELLINGS AND DEVELOPERS HAVE BEEN FORCED INTO BUILDING CONDOMINIUMS. <br />HE FELT IF THERE WERE SOME ORDINANCE FOR "ZERO LOT LINE" DWELLINGS OR <br />PARTY WALL WHERE YOU JUST OWN YOUR PROPERTY AND MAINTAIN YOUR SIDE OF <br />THE PARTY WALL, AND THEY MAINTAIN THEIR SIDE, IT WOULD ELIMINATE A LOT <br />OF THE PROBLEMS ASSOCIATED WITH COMMON OWNERSHIP OF PROPERTY. <br />25 <br />._ BOO39 PAGE 2 � 5 <br />MAR 211979 <br />
