WITH REGULATIONS OF THE FEDERAL AGENCIES. HE FURTHER NOTED THAT THERE <br />ARE MANY APPLICATIONS IN FRONT OF THE CORPS OF ENGINEERS FOR FILLING <br />HUNDREDS OF ACRES IN THE COUNTY BELOW THE 5' LIMIT, SOME EVEN BELOW 2', <br />AND HE FELT IF THE BOARD IS GOING TO SET SUCH A LIMIT ALONG THE WHOLE <br />SEBASTIAN RIVER, IT SHOULD BE DONE IN THE WHOLE COUNTY. HE PRESENTED <br />THE BOARD WITH A COPY OF STATE LAWS AND A BOOKLET EXPLAINING FEDERAL <br />RESTRICTIONS. <br />COMMISSIONER LYONS EXPLAINED THAT THE BOARD'S INTENTION IS <br />MERELY TO TRY TO KEEP THE SEBASTIAN RIVER IN THE GOOD SHAPE IT IS IN - <br />NOW AND AGREED THAT POSSIBLY WE ARE NOT APPROACHING THIS IN THE RIGHT <br />WAY. HE FELT WHAT IS MAINLY DESIRED IS MORE OR LESS A WARNING FLAG TO <br />LET THE OWNER KNOW HE DOESN'T HAVE CARTE BLANCHE TO DO WHATEVER HE WANTS <br />WITH THE PROPERTY. COMMISSIONER LYONS FELT THE PROBLEM 'IS NOT S0 MUCH <br />WITH THE DEVELOPER, WHO UNDERSTANDS THE PROBLEM, AS WITH THE PERSON <br />WHO BUYS THE LOT FROM THE DEVELOPER, AND HE, THEREFORE, WANTED SOMETHING, <br />ON THE PLAT TO MAKE THEM AWARE OF THE PROBLEM. HE FELT A STATEMENT SUCH <br />AS "NO FILL IN THE AREA NORMALLY SUPPORTING WETLAND VEGETATION" MIGHT <br />BE SUFFICIENT. <br />DR. FISCHER INFORMED THE BOARD THAT AFTER HE SELLS THESE LOTS, <br />THE PROPERTY GOES INTO A PROPERTY OWNERS ,ASSOCIATION, WHICH HAS BY-LAWS <br />AND RESTRICTIONS THEY HAVE TO FOLLOW SO YOU WILL SEE NO HOMES BUILT <br />WITHIN THE 5' LIMITS ON ANY FILL THAT WOULD BE LIABLE TO GO INTO THE <br />' RIVER. THE FEDERAL AGENCIES CONTROL THE VEGETATION VERY ADEQUATELY. <br />MR. CATO, A LONG TIME DEVELOPER OF THE SEBASTIAN AREA, POINTED <br />OUT TO THE BOARD THAT FEDERAL AUTHORITIES CONTROL FAR BELOW THE 5' <br />LEVEL. HE STATED THAT THE DEPARTMENT OF INTERIOR FLIES OVER THE AREA, <br />PHOTOGRAPHS IT CONTINUALLY, AND SEES THAT PROPER RESTORATION IS MADE OF <br />ANY VIOLATION. HE DISCUSSED THE DEVELOPMENT NEXT TO THE FISCHER PROP- <br />ERTY, WHICH HE STATED IS BEAUTIFULLY CONTROLLED. MR. CATO NOTED THAT i <br />THE MEANDERING COURSE OF HIGH LANDS AND LOW LANDS THROUGH DR..FISCHER'S <br />• i <br />HOLDINGS IS SO IRREGULAR THAT IT REQUIRED A GREAT DEAL OF LEEWAY TO MAKE <br />PARCELS THAT ARE USABLE.
