CATO AGREED THAT IT IS THE SECOND PARTY AFTER THE <br />DEVELOPER WHO IS MORE LIKELY TO CAUSE THE PROBLEM. <br />CHAIRMAN WODTKE ASKED IF HE WOULD SAY THE SEBASTIAN RIVER <br />SHOULD BE TREATED EXACTLY THE SAME AS THE INDIAN RIVER AND WHETHER HE <br />FELT THE TIDAL SITUATION IS THE SAME. <br />MR. CATO INFORMED THE BOARD THAT THEY HAVE STUDIED THE WIND - <br />TIDE AFFECT ON THE SEBASTIAN RIVER, THE WATER FROM DRAINAGE, ETC., AND <br />DO NOT FEEL IT SHOULD BE TREATED DIFFERENTLY. HE DISCUSSED HIS PROJECT <br />IN THIS AREA, NOTING THAT HE PUT IN CYPRESS BOARDWALK, AND THE SALES <br />BROCHURE REFERS TO IT AS "PRISTINE TROPICAL" LAND. HE STATED THAT THE <br />DEPARTMENT OF INTERIOR HAS EXPRESSED ADMIRATION OF THEIR CONTROL OF THE <br />PROJECT. <br />COMMISSIONER SIEBERT FELT IF THE DEVELOPERS OF SANS SEBASTIAN <br />SPRINGS WOULD AGREE TO PUT THE STATEMENT SUGGESTED BY COMMISSIONER <br />LYONS ANO FILL IN THE AREA SUPPORTING, OR NORMALLY SUPPORTING WETLAND <br />VEGETATION.), THAT WOULD BE SATISFACTORY. <br />COMMISSIONER LOY AGREED THAT COMMISSIONER LYONS HAS OUTLINED <br />OUR REAL CONCERN, <br />ATTORNEY COLLINS SOGGESTED THIS BE ON THE DEDICATION ITSELF <br />AND ON THE PLAT. HE POINTED OUT THAT WHEN THE BOARD GRANTED TENTATIVE <br />APPROVAL, IT WAS DONE WITH A CONDITION, AND FELT IF THE BOARD IS GOING <br />TO CHANGE THAT CONDITION, IT SHOULD BE DONE BY MOTION.. <br />ON MOTION BY COMMISSIONER LYONS, SECONDED BY COMMISSIONER <br />SIEBERT, THE BOARD UNANIMOUSLY AGREED TO CHANGE THE REQUIREMENTS OF THE <br />TENTATIVE APPROVAL OF SANS SEBASTIAN SPRINGS TO DELETE THE REFERENCE <br />TO THE 5' CONTOUR AND TO REQUIRE INSTEAD THAT THE.FOLLOWING STATEMENT, <br />"THERE SHOULD BE NO FILL IN THE AREA SUPPORTING, OR NORMALLY SUPPORTING <br />WETLAND VEGETATION" BE INCLUDED BOTH IN THE DEDICATION TO BE FILED OF <br />RECORD AND ON THE PLAT ITSELF. <br />ON MOTION BY COMMISSIONER LYONS, SECONDED BY COMMISSIONER <br />DEESON, THE BOARD UNANIMOUSLY ADOPTED RESOLUTIONS M0. 79-30 AND NO. <br />79-3I HONORING ASSISTANT PLANNING DIRECTOR ROBERT M.
