COMMISSIONER SIEBERT FELT THAT THIS MIGHT CONSTITUTE SPOT <br />ZONING, AND PLANNER REDICK AGREED IT MIGHT TO SOME EXTENT, BUT SINCE IT <br />DOES EXIST, THEY WOULD RATHER MAKE IT CONFORMING SO IT COULD MORE EASILY <br />BE UPGRADED. <br />THE CHAIRMAN ASKED IF ANYONE PRESENT WISHED TO BE HEARD. <br />ATTORNEY BOGOSIAN INFORMED THE BOARD THAT HE IS REPRESENTING <br />MR. AND MRS. RYBACKI AND MR. AND MRS. GILLEN. HE PRESENTED ATTORNEY <br />COLLINS A DEED SHOWING OWNERSHIP AND LEGAL DESCRIPTION. <br />ATTORNEY BOGOSIAN INFORMED THE BOARD THAT MR. AND MRS. RYBACKI <br />BOUGHT THE PROPERTY BACK IN 1974 AS A MOBILE HOME PARK. THEY SPENT <br />MONEY TO UPGRADE THE SEWER PLANT AND EXPAND THE WATER PLANT AND ALSO <br />SPENT MONEY ON FILL AND PUT IN AN UNDERGROUND ELECTRICAL SYSTEM, ALL <br />WITH THE INTENTION OF GETTING INTO THE BACK FIVE ACRES, MR. AND MRS. <br />rRYBACKI SOLD MOST OF THE PARK TO THEIR DAUGHTER AND SON-IN-LAW, THE <br />GILLENS, AND THE RYBACKIS OWN THE REAR AREA. HE CONTINUED THAT VISTA <br />PROPERTIES ARE PURCHASING OTHER PARCELS IF THEY ARE ZONED R -2C, BUT HIS <br />CLIENTS ARE NOT -WILLING TO SELL BECAUSE -OF PLANS TO EXPAND. HE STATED <br />THAT VISTA PROPERTIES HAD NO PROBLEM WITH THIS AND STATED THAT COULD <br />DEVELOP AROUND IT. ATTORNEY BOGOSIAN NOTED THAT IF THIS WERE REZONED <br />R -2C, IT WOULD BE RIGHT NEXT» TO COMMERCIAL, AND IN ADDITION, •IT WOULD <br />BE USELESS BECAUSE THERE IS NO ACCESS TO THE REAR EXCEPT THROUGH THE <br />MOBILE HOME PARK. THUS, THE RYBACKIS COULD ONLY SELL IT TO VISTA <br />PROPERTIES ON THEIR TERMS AND CONDITIONS. <br />ATTORNEY COLLINS POINTED OUT TO THE BOARD THAT THIS REZONING <br />REQUEST WAS INITIATED BY THE PLANNING AND ZONING COMMISSION, AND THEN <br />THEY DECIDED TO LEAVE THE RYBACKIS PROPERTY AS IT WAS. HE, THEREFORE, <br />FAILED TO SEE WHY THE BOARD IS CONSIDERING THIS PIECE OF PROPERTY AT ALL. <br />AFTER FURTHER DISCUSSION, THE BOARD AGREED. <br />THE CHAIRMAN ASKED IF ANYONE ELSE WISHED TO BE HEARD. THERE <br />WERE NONE. <br />ON MOTION BY COMMISSIONER LYONS, SECONDED BY COMMISSIONER <br />SIEBERT, THE BOARD UNANIMOUSLY ADOPTED ORDINANCE No. 79-9 REZONING THE <br />WEST 1/2 OF THE NW 1/4 OF THE SW 1/4 OF THE NW 1/4 OF SECTION IS, TOWN- <br />SHIP 33 SOUTH, RANGE 40 EAST, AND'THE EAST 1/2 OF THE NII 1/4 OF THE <br />57 <br />MAR 211979 <br />r 39 PA-UE307 <br />
