She asked if we have the ability to remove the height exception without <br />a problem should the business never build. <br />Attorney Collins said that a clause could be added saying that the west county industrial <br />park height exception will sunset and stand repealed if not utilized by a certain date, unless <br />readopted by an ordinance. or leave it as it is. He advised it is better to have a sunset clause to stay <br />away from the Bert Harris Private Property Act issues. <br />Commissioner Macht added that this is a planned development park that the Board has <br />total control over. It can be repealed at anytime. <br />Director Boling clarified that this ordinance amends the building height exception up to <br />80 feet. When they get to the planned development they can be more specific. <br />Commissioner Macht understood there are legitimate concerns that the height exception <br />accommodates a particular industry. He said it was carefully crafted for a developer who needed <br />it. To eliminate concerns, he suggested having a referendum that states any extension beyond the <br />35’ for human occupancy would have to be approved by the voters, not the Commissioners. He <br />related that he perceives the quality of life in our county as being number one in disparity of <br />income in the State of Florida which stems mostly from our economy. We need good jobs and a <br />temporary sight of a building or a tiny intrusion over the sight line is not a reason to decline this <br />proposal. <br />Commissioner Adams said it appears that the building is about 402’ from the nearest <br />home. She felt doing some landscaping would greatly help the sight line by obscuring the <br />building, and that it is incumbent upon the Commissioners to try to give the public their yards and <br />th <br />their views.
