acquire the attached properties by the institution of <br />proceedings in eminent domain, and providing an <br />effective date. <br />[Parcel 107] <br />ON MOTION by Vice Chairman Flescher, <br />SECONDED by Chairman Davis, the Board <br />unanimously approved Resolution 2009-027 <br />declaring a reasonable necessity to acquire certain <br />real property for the purposes of improving and <br />reconstructing 66th Avenue, including side street, <br />intersection, sidewalk and water retention pond <br />improvements; authorizing the County Attorney to <br />acquire the attached properties by the institution of <br />proceedings in eminent domain, and providing an <br />effective date. <br />[Parcel 404] <br />Joseph Paladin requested clarification on the take of property by eminent <br />domain, and whether staff would proceed immediately with a lawsuit if an offer was not <br />accepted in 30 days. <br />Attorney DeBraal explained how the sale/purchase would be pursued. He and Mr. <br />Paladin engaged in further discussion about negotiations versus proceeding with the lawsuit. <br />Ruth Stanbridge, 4835 66th Avenue, said clarification, parameters and time- <br />frame were needed. She stated that they were ready to go under the court system so they could <br />have some parameters, and she urged the Board to do whatever it takes to get them into court. <br />March 17, 2009 38 <br />
