AUG 81979 <br />mai 41 uu 355 <br />ATTORNEY COLLINS DISCUSSED THE PROJECTION MADE BY THE FINANCE <br />OFFICER AS TO WHAT NON AD VALOREM FUNDS ARE AVAILABLE FOR THE MUNICIPAL <br />SERVICE TAXING FUND. HE STATED THAT AFTER TALKING TO.MR. BARTON, IT IS <br />HIS UNDERSTANDING THAT WE DO NOT HAVE A PROBLEM AT THIS POINT - THE <br />MUNICIPAL SERVICE TAXING FUND CAN HANDLE THE CONTRIBUTION FOR FIRE <br />SERVICES THROUGH AD VALOREM TAXES AND THE BALANCE CAN BE PAID THROUGH <br />NON AD VALOREM SOURCES. <br />CHAIRMAN WODTKE ASKED THE ATTORNEY WHAT HE HAS LEARNED ABOUT <br />HAVING A HEARING OFFICER FOR THE PROPERTY APPRAISAL ADJUSTMENT BOARD. <br />ATTORNEY COLLINS INFORMED THE BOARD THAT CHAPTER 194 PROVIDES <br />THAT THE PROPERTY APPRAISAL ADJUSTMENT BOARD CAN HIRE A SPECIAL MASTER <br />TO HEAR CASES IN THE BOARDS STEAD; THE SPECIAL MASTER REPORTS BACK TO <br />THE BOARD WITH FINDINGS OF FACT AND CONCLUSIONS OF LAW; AND THE BOARD <br />ACTS ON THAT. THE PURPOSE OF THE SPECIAL MASTER IS TO SAVE TIME FOR THE <br />BOARD. THE STATUTE REQUIRES THAT THE SPECIAL MASTER BE A RESIDENT OF <br />THE COUNTY IN WHICH THE BOARD SITS. THE ATTORNEY CONTINUED THAT HE HAS <br />CALLED TWO PEOPLE WITH GENERAL EXPERTISE IN APPRAISING - PHIL HOUK, <br />M.I.A., WHO IS STRONG IN AGRICULTURE, AND .JACK SHERMAN. THEY HAVE <br />INDICATED SOME INTEREST; THERE ARE OTHER CITIZENS WITH APPRAISAL BACK- <br />GROUND, HE NOTED THAT THE PROPERTY APPRAISAL ADJUSTMENT BOARD ITSELF <br />IS THE BOARD WHICH MAKES THE DECISION AS TO WHETHER OR NOT TO HAVE A <br />SPECIAL MASTER, AND THE EXPENSE IS SHARED 3/5 BY THE BOARD OF COUNTY <br />COMMISSIONERS AND 2/5 BY THE SCHOOL BOARD. <br />CHAIRMAN WODTKE NOTED THAT THE SPECIAL MASTER WOULD HEAR CASES <br />WITHOUT THE PRESENCE OF THE BOARD AND ASKED IF THE BOARD WOULD HAVE AN <br />OPPORTUNITY TO HEAR THE TESTIMONY. <br />ATTORNEY COLLINS ANSWERED THAT THEY HAVE THE RIGHT TO, IF THEY <br />WISH, BUT GENERALLY THEY JUST REVIEW THE FINDINGS. <br />CHAIRMAN WODTKE INQUIRED ABOUT THE TIME FRAME INVOLVED FOR THE <br />HEARING OFFICER TO WRITE UP HIS OPINIONS AND THEN FOR THE BOARD TO REVIEW <br />THEM AND MAKE A DECISION. <br />ATTORNEY COLLINS FELT THE SPECIAL MASTER WOULD HAVE TO BE <br />GEARED INTO GETTING THE FINDINGS AND CONCLUSIONS OUT PRETTY MUCH THE <br />112 <br />
